HomeMy WebLinkAboutORD 1963BILL NO. 27_ ORDINANCE TJO..1 963 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO FROM R -3 (HIGH DENSITY RESIDENTIAL) TO C -3 (FRAME AND SERVICE COMMERCIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS C -3 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho; WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 6 -4 -3 Caldwell Code, that the following described property be rezoned from R -3 (High Density Residential) to C -3 (Frame and Service Commercial) and that said rezoning is in the best interest of the City of Caldwell, Idaho. Said property is located generally between S. Georgia Avenue and Florida Avenue on Cherry Street (3202 Cleveland) and is more particularly described as follows: The South 1/2 of Tract "U" MOUNTAIN VIEW SUBDIVISION, Northeast Quarter of the Northwest Quarter, SEction 35, Township 4 North, Range 3 West, Boise Meridian, Caldwell, Canyon County, Idaho, except that portion COMMENCING at the Southwest corner of the Southeast Quarter of the Northeast Quarter of the Northwest Quarter (CE -NW 1/64 corner); thence North 0 26' 37" East a distance of 25.00 feet to the Southwest corner of said Tract "U ", the POINT OF BEGINNING; thence continuing North 0 26' 37" East a distance of 142.00 feet along the Westerly boundary of said Tract "U "; thence North 89 35' 49" East a distance of 120.00 feet parallel with the Southerly boundary of said Tract "U "; thence South 0 26' 37" West a distance of 142.00 feet parallel with the Westerly boundary of said Tract "U" to a point on the Southerly boundary of said Tract "U "; thence South 89 35' 49" West a distance of 120.00 feet along the Southerly boundary of said Tract "U" to the POINT OF BEGINNING. 1 i IT IS HEREBY ORDAINED AS FOLLOWS: Section 1. That certain land described above is now zoned C -3 (Frame and Service Commercial) after the date of this ordinance. Section 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being C -3. Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 4. This ordinance shall be in full force and effect from and after its passage. PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this - day of September , 1992.
