ORDINANCE NO. 195.4
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL STATE OF IDAHO, BY DELETING AND ADDING CERTAIN
LANGUAGE IN TITLE X, CHAPTER 1, SECTION 1 PERTAINING TO
ADOPTION OF UNIFORM FIRE CODE; SECTION 6 PERTAINING TO
ESTABLISHMENTS OF LIMITS OF DISTRICTS IN WHICH STORAGE OF
EXPLOSIVE AND BLASTING AGENTS IS TO BE PROHIBITED; SECTION 7
PERTAINING TO AMENDMENTS IN THE UNIFORM FIRE CODE: REPEALING
ALL ORDINANCES, RESOLUTIONS, ORDER OR PARTS THEREOF IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 1 of Chapter 1, Title X be amended
as follows:
10 -1 -1: ADOPTION OF 148$ 1991 UNIFORM FIRE CODE: There is hereby
adopted by the Mayor and Council of the City of Caldwell,
County of Canyon, State of Idaho for the purpose of
prescribing regulations governing conditions hazardous to
life and property from fire or explosion, that certain
code and standards known as the Uniform Fire Code,
including appendix Chapters I -A , 1-- &, h-C, II -A, II -B, II-
D, II -E, I -F , III -A, III -B, III -C, III -D, IV -A, IV -B , V-
A, VI-A, VI-B VI -D, VI -E , and the Uniform Fire Code
Standards published by the Western Fire Chiefs Association
and the International Conference of Building Officials,
being particularly the 194 1991 Editions thereof and the
whole thereof, save and except such portions as are
hereinafter deleted, modified or amended by Section 10 -1 -7
of this Chapter are now on file in the Office of the
Caldwell Fire Department and the same are hereby adopted
and incorporated as fully as if set out at length herein,
and from the date on which this Chapter shall take effect,
the provision thereof shall be controlling within the
limits of the City of Caldwell, County of Canyon, State of
Idaho.
Section 2. That Section 6 of Chapter 1, Title X be amended
as follows:
10 -1 -6: ESTABLISHMENTS OF LIMITS OF DISTRICTS IN WHICH STORAGE
OF EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED:
The limits referred to in Section 77 .107(a ) of
the Uniform Fire Code, in which storage of explosives and
blasting agents is prohibited, are hereby established as
follows: In all zoning districts and overlay zones,
except M -1, M -2 and I -P without overlay zones with the
approval of the Chief.
Section 3. That Section 7 of Chapter 1, Title X be amended

(D) Section 80.303(a)6.D(i) Uniform Fire Code, be and the same
is amended by the addition of, and to read as follows:
Exception: Upon approval of the Fire Chief, emergency
response kits approved for the size of tanks on site and
in use as recommended by the chlorine institute may be
used for chlorine gas product leaks in lieu of the
treatment system requirements of this section as long as
there are two responders who are trained in their use
employed by the user.

Section 4.1 A permit,_when required by the Chief
shall be ob tained from the Bureau of Fire_ Preventio
prior to engaging in the following activities
operations, practices or functions
(B) That Article 78 "Fire Works" 1991 Uniform Fire Code be
delet with t he exception of:

(C) Section (79.115(f) Uniform Fire code, be, and the same

Exception: Under round tanks that comply with the
Qerformance standards for new or upgraded underground
tanks set forth in 40 CFR 280.20 or 40 CFR 280.21 E.P.A

long as they remain in compliance with the operation
maintenance, and release detection requirements of th
final rule.
(D) Section 80.303 (a) 6.D (i) Uniform Fire Code, be and the

follows:

Section 2. All ordinances or parts of ordinances
inconsistent herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according
to law.
