HomeMy WebLinkAboutORD 1944BILL NO. 8 ORDINANCE NO. 1944 AN ORDINANCE OF THE CITY OF CALDWELL, IDAHO, PROVIDING AUTHORITY FOR AN INFRASTRUCTURE IMPROVEMENT POLICY INCLUDING A STREET CONSTRUCTION IMPROVEMENT POLICY, A POLICY FOR OPENING ALLEYS AND A STREET LIGHTING POLICY. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That the City Council may set or amend, by resolution, policies that will govern development standards in the area of streets, alleys and street lighting or other areas that may be appropriate. Section 2. That these policies will be entitled The Infrastructure Improvement Policy to include a Street Improvement Policy, Policy for Opening Alleys, and Street Lighting Policy. Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 4. ATTEST: City C INFRASTRUCTURE IMPROVEMENT POLICY GENERAL INFORMATION Effective June 1, 1992, the policies described below concerning street and alley openings, sidewalk, curb & gutter improvements, shall be followed. This revised policy places the emphasis on property owners to construct improvements directly benefiting their property, but at the same time providing uniform standards for our City and it's citizens as a whole. This policy is specifically revised to provide for paved streets, curb & gutters and sidewalk improvements. These policies address all development outside of that which falls under the City subdivision Ordinance (Section 5 - 8-4 of the City Code). It shall be the policy of the City to not issue any building permits on lots of record unless they have frontage upon a City street which has been declared opened by the City. In order to be declared open, a street must meet the standards described below and be inspected and approved by the City Engineer or his designee. All improvements will be done at the property owners expense, however, once accepted, all road improvements (not including curb & gutter and sidewalk) shall be maintained by the City. Should a situation arise when a portion of the improvement standards described below are deferred, the property owner, as part of this agreement, shall sign a deferral (see attached) in which he /she agrees to participate, without protest, in constructing the improvements as part of a Local Improvement District or other funding mechanism. The City is also willing to require a cost reimbursement participation agreement should a property owner have to construct more than his share of improvements. This agreement will require reimbursement of costs to the party who made the initial investment (see attached). In both instances (deferred improvements and cost reimbursements) building permits will not be issued without agreements in these areas. • 0 CITY OF CALDWELL STREET DEPARTMENT POLICIES FOR OPENING ALLEYS The following are the conditions under which the City of Caldwell Street Department will open alleys. 1. The right -of -way for the street must be deeded or dedicated to the City. 2. A majority of the property owners adjacent to the alley must desire to have it opened. A petition signed by those desiring to have the alley opened should be submitted to the City Engineer. 3. All irrigation facilities which are in the right -of -way must be relocated by or at the expense of those desiring to have the alley opened. 4. All fences, trees and buildings must be removed from the right -of -way by those who desire the alley opened. S. Any shrubbery, bushes, flowers, etc. which are to be saved by the adjacent property owners should be removed by them. 6. All wood, lumber or other personal property must be removed by the owners. 7. The pipe of adequate size and type must be furnished and installed for all drain ditches which cross the alley. 8. After the above has been completed, the City will do the necessary blading, filling and graveling such that the alley will be in an all- weather condition. SIDEWALK CONSTRUCTION & IMPROVEMENT POLICY Sidewalk, curb and gutters are required in any development on a public street. They shall meet the standards specified below: SIDEWALKS: Pursuant to Title VII, Chapter I, Section S of the City Code of Caldwell there is hereby established the sidewalk construction and improvement standards for the City of Caldwell as follows: All sidewalks within the City of Caldwell shall have a minimum width of four (4) feet. All sidewalks shall be constructed to the line and grade established by the City Engineer. All sidewalks shall have a thickness of four (4) inches of Portland Cement concrete and compacted granular base of six (6) inches. All concrete shall be six bag mix. The construction methods, forms, placement, expansion joints, finishing and curing shall conform to the specifications for concrete and for sidewalk in the Local Improvement Districts in the City of Caldwell. The inspection of forms shall be made by the City Engineer's Office prior to the pouring of any concrete. Should surrounding property on either side have such improvements, this policy must be adhered to strictly, with no exceptions. However, should surrounding property not have such improvements, the City Engineer may waive the requirements, rop vided that the property owners developers are willing to sign a deferral, committing to installing such improvements upon request of the City. CURB, GUTTER AND VALLEY GUTTERS: All curb and gutter shall be standard six (6) inch verticle curb with eighteen (18) inch gutter plate or standard rolled curb two (2) feet from back of curb to edge of gutter platt as directed by the City Engineer. Both rolled and verticle curb and gutter shall have a minimum of six (6) inch compacted granular base. All cement shall be six (6) bag mix. STREET IMPROVEMENT POLICY All streets in any development are required to have curb and gutter and be paved with an acceptable asphalt surface as approved by the City Engineer. In addition, the following conditions must be met to open the street for public use: 1. The right -of -way for the street must be deeded or dedicated to the City. 2. All irrigation facilities which are in the travelway must be moved by those desiring to have the street opened. All irrigation ditches must be tiled at the expense of those desiring to have the street opened. All tiled lines and crossings must be water tight and must be approved by the City Engineer. 3. All drain ditches mush be tiled or moved by or at the expense of those desiring the street opened. All tiled lines and crossings must be water tight and must be approved by the City Engineer. 4. All fences, trees and buildings must be removed from the travelway by those who desire the street opened. S. Any shrubbery, bushes, flowers, etc., which are to be saved by the property owners adjacent should be removed by them. 6. The pipe must be furnished and installed for all street drainage crossings. 7. See Subdivision Requirements - Section 5 -8 -3, for construction standards. Should the street to be improved connect at either end of a City block (300 feet) to a paved public right -of -way with curb and gutter this policy must be adhered to strictly, with no exceptions. However, should the street connect to other public right -of -ways that are graveled, or not fully improved, the City Engineer may waive the requirements, provided that the property owner /developers, commit to constructing such improvements upon request of the City.
