ORDINANCE NO. 1943
AN ORDINANCE OF THE CITY OF CALDWELL, AMENDING TITLE III, CHAPTER
3B OF THE CALDWELL MUNICIPAL CODE, BY AMENDING SECTION 3 -3B -2 BY
DELETING THEREFROM ANY REFERENCE TO THE MEMBERS OF THE TREATMENT
PLANT DEPARTMENT AND INSERTING THEREIN THE AUTHORIZED CITY REPRE-
SENTATIVE; BY REPEALING SECTIONS 3- 3B -18(E) THROUGH AND INCLUDING
3- 3B -21; AND BY PROVIDING FOR A NEW SECTIONS 3- 3B -18(E) THROUGH
AND INCLUDING 3 -3B -21 WHICH PROVIDE FOR BILLING FREQUENCY,
ESTABLISHING RESIDENTIAL SEWER USER CHARGES, ESTABLISHING NON-
RESIDENTIAL SEWER USER CHARGES, ESTABLISHING SEWER USER CHARGES
FOR CONNECTIONS OUTSIDE THE CITY LIMITS, FOR THE EMPOWERMENT OF
THE WATER SUPERINTENDENT TO REQUIRE METERING OF PRIVATE WATER
SUPPLIES, FOR THE RECEIPT AND PROCESSING BY THE FINANCE DIRECTOR
OF PAYMENTS FOR SEWER, FOR THE PROCESSING OF DELINQUENT ACCOUNTS,
FOR A POLICY FOR TERMINATION AND RESTORATION OF SEWER SERVICE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That Section 3 -3B -2 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3 -3B -2: RESPONSIBILITY: It shall be the responsibility of
all members of the Treatment PlaRt HepartmeRt h reRresentative
authorized hy tM City Council to construct, extend, maintain,
repair, replace, operate and remove systems facilities and equip-
ment used for the collection, conveyance, treatment and disposal
of sanitary sewage from domestic, commercial, industrial, and
such other uses and purposes for which said facilities may be
used to promote health, safety and the general welfare.
Section 2. That Section 3-3B-18(E)., Section 3- 3B- 18(F),
Section 3- 3B- 18(G), Section 3- 3B- 18(H), Section 3- 3B- 18(I),
Section 3- 3B -19, Section 3 -3B -20 and Section 3 -3B -21 of the
Municipal Code of the City of Caldwell, be, and the same are
hereby repealed.
Section 3. That Chapter 3B of Title 3 Municipal Code of the
City of Caldwell be, and the same is hereby amended by the
addition of New Sections to be known and designated as Sections
3- 3B- 18(E), 3- 3B- 18(F), 3- 3B- 18(G), 3- 3B- 18(H), 3- 3b- 18(I), 3 -3B-
19, 3 -3B -20 and 3- 3B -21, and the same shall read as follows:
3- 3B- 18(E): BILLING FREQUENCY: Billing cycle frequency and
due dates for accounts shall be established in the Billing
Policy, as adopted by Resolution of the City Council.
3- 3B- 18(F): RESIDENTIAL SEWER USER CHARGES: Residential
sewer charges shall be based on average water usage during the
four (4) month consumption period from October 1 through March 31
and shall be adjusted annually to reflect current use. Properties
with 3 or fewer dwelling units shall be classified residential.
3- 3B- 18(G): NON - RESIDENTIAL SEWER USER CHARGES: Connections
to the sewer system not classified as residential shall be billed
based on the actual water metered during the consumption period.
3- 3B- 18(H): SEWER USER CHARGES OUTSIDE CITY LIMITS: All
residential and non - residential users outside the city limits
shall be billed based on the actual water metered during the
consumption period at two times the sewer user charges for sewer
users inside the city limits.
3- 3B- 18(I): POWERS OF THE WATER SUPERINTENDENT: The Water
Superintendent or authorized representative shall require all
sewer users to install an approved and accessible water meter on
all private water supplies discharging into the sewer system for
determining sewer usage. Installation shall be at the expense of
the property owner. Failure to install a water meter within sixty
(60) days after written notice by the Water Superintendent will
result in termination of sewer service at the expense of the
property owner.
3- 3B -19: SEWER PAYMENTS: Payments due the City of Caldwell
shall be received and processed by the Finance Director of the
City of Caldwell, in accordance with Idaho Code.
3- 3B -20: DELINQUENT ACCOUNTS: Sewer charges billed shall
become delinquent on the due date. Delinquent accounts shall be
processed in accordance with the billing policy adopted by
resolution of the City Council.
3- 3B -21: SERVICE TERMINATION: Service shall be terminated
and restored in accordance with the Billing Policy and Rate
Schedule adopted by resolution of the City Council.
