ORDINANCE NO. 1940
AN ORDINANCE OF THE CITY OF CALDWELL, AMENDING TITLE III,
CHAPTER 3A, OF THE CALDWELL MUNICIPAL CODE, BY AMENDING
SECTION 3 -3A -7 BY DELETING THEREFROM ANY REFERENCE TO THE
BUILDING INSPECTOR AND INSERTING THEREIN THE WATER SUPERIN-
TENDENT, AND DELETING THE REQUIREMENT FOR A DEPOSIT UPON
APPLICATION FOR CONNECTION AND PROVIDING FOR CHANGES IN THE
APPLICATION FORM; BY AMENDING SECTION 3 -3A -8 BY THE DELETION
OF THE REFERENCE TO BILLING POLICY AND PROVIDING FOR THE
ADOPTION OF RATE SCHEDULE FOR METERS TO BE ADOPTED BY RESO-
LUTION; BY AMENDING 3 -3A -15 BY PROVIDING THAT REQUESTS FOR
WATER LINE CONNECTION OUT SIDE THE CITY LIMITS TO BE
GOVERNED BY SERVICE CONNECTION POLICY; BY AMENDING SECTION
3- 3A -16(C) BY PROVIDING FOR THE ADOPTION OF A RATE SCHEDULE
FOR THE EXTENSION OF CITY WATER MAINS; BY AMENDING SECTION
3 -3A -22 BY PROVIDING A RATE SCHEDULE ADOPTED BY RESOLUTION
TO GOVERN SERVICE CONNECTION AND INSPECTION FEES FOR
PROPERTIES OUTSIDE THE CITY LIMITS; BY AMENDING SECTION 3-
3A-23 TO PROVIDE FOR A CAPITAL IMPROVEMENT BASE FEES; BY
AMENDING SECTION 3 -3A -24 BY PROVIDING FOR A DEVELPOPER TO
PAY A SERVICE CONNECTION FEE AND DELETING THEREIN REFERENCE
TO THE CITY ENGINEER AND INSERTING THEREIN THE WATER
SUPERINTENDENT; BY AMENDING SECTION 3 -3A -27 BY PROVIDING
THAT WATER USER CHARGES AND FEES BEGIN WHEN THE WATER IS
TURNED ON AND SHALL BE BASED UPON THE AMOUNT OF WATER USED,
AND PROVIDING FOR CHARGES FOR SHUT OFF AND TURN ON BE GOVER-
NED BY THE RATE SCHEDULE; BY REPEALING SECTIONS 3 -3A -28
THROUGH AND INCLUDING 3- 3A -32; AND BY PROVIDING FOR A NEW
SECTIONS 3 -3A -28 THROUGH AND INCLUDING 3 -3A -32 WHICH PROVIDE
FOR BILLING FREQUENCY, FOR THE RECEIPT AND PROCESSING BY THE
FINANCE DIRECTOR OF PAYMENTS FOR WATER, FOR THE PROCESSING
OF DELINQUENT ACCOUNTS, FOR THE ESTABLISHMENT AND EMPOWER-
MENT OF THE UTILITY BOARD, FOR A POLICY FOR TERMINATION AND
RESTORATION OF WATER SERVICE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF CALDWELL, IDAHO:
Section 1. That Section 3 -3A -7 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3 -3A -7: APPLICATION FOR SERVICE CONNECTION AND PERMIT TO
USE WATER: Application to have a City water service including a
meter installed shall be made by the owner of the premise to the
Building inspeeteF Water Superintendent or other assigned
officer. The application shall contain a full, true and acurate
statement of the size of the connection, a description of the
premises upon which such connection is to be made, together with
the full name of such owners to conform to the rules and
regulations provided for the City water system and that

Section 2. That Section 3 -3A -8 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3 -3A -8: METERS PROPERTY OF THE CITY: All meters shall be
and remain the property of the City, and in the event of a meter
getting out of order and failing to register, the consumer shall
be charged based upon estimated average sensumpt #en determined #n

Section 3. That Section 3 -3A -15 of the Caldwell Municipal

Section 4. That Section 3- 3A -16(C) of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3- 3A- 16(C): EXTENSION OF CITY WATER MAINS AND WATER MAIN
FEE: The City shall charge a water main fee on all new buildings
and developments that will be provided water service from
existing ®kty mains. The amount of the fee and the methods of
derivation shall be adopted by reseAutkeR of the e#ty EeuReti*
in accordance with t e Rate Schedule AdoRted by Resolution 21

Section 5. That Section 3 -3A -22 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:

Section 6. That Section 3 -3A -23 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3- 3A -23: IMPACT FEES AM BASE CHARGES The City shall have
authority to assess the developer and /or landowner fees in
addition to the aforementioned fees. These additional fees are
termed impact and c aRital ,iMprovement base fees and are for
the purpose of providing a more equitable distribution of City
water system costs relating to such items as water supply
development, storage, transmission lines and other off -site

Section 7. That Section 3 -3A -24 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:

A copy of current keekap ekaeges service connection fees for
various meter sizes will be on file in the Gity ERgineepLe
Water SuRarintendent's office.
Section 8. That Section 3 -3A -27 of the Caldwell Municipal
Code be and the same is hereby amended to read as follows:
3- 3A -27: WATER USER CHARGES AND FEES:
(A) The water user charges and fees shall be extablished to
cover operation and maintenance costs of the City water system,
and to provide a fund to pay for capital improvement costs,
additions, participation in oversized extensions to the system,
or redemption of bonds that have been used to finance system
improvements, all as a part of the City's responsibility to
provide adequate domestic water service and facilities for the
City. For new connections, the water user charge is to begin
when the meter is eeRRee €ed turned=. All owners who derive
benefit from the City's water system shall, in return for said
benefit, pay user charges. The user charge shall be based on the
amount of water used. and the ame%R€ e€ fire and health pse-
tee €keR peevided by the Gity water systemr

Section 9. That Section 3- 3A -28, Section 3- 3A -29, 3- 3A -30,
Section 3- 3A -31, Section 3 -3A -32 and Section 3 -3A -33 of the
Municipal Code of the City of Caldwell, be, and the same are
hereby repealed.
Section 10. That Chapter 3A of Title 3 Municipal Code of
the City of Caldwell be, and the same is hereby amended by the
addition of New Sections to be known and designated as Sections
3- 3A -28, 3- 3A -29, 3- 3A -30, 3 -3A -31 and Section 3- 3A -32, and the
same shall read as follows:
3- 3A -28: BILLING FREQUENCY: Billing cycle frequency and due
dates for accounts shall be established in the Billing Policy,
as adopted by Resolution of the City Council.
3- 3A -29: WATER PAYMENTS: Payments due the City of Caldwell
shall be received and processed by the Finance Director of the
City of Caldwell, in accordance with Idaho Code.
3- 3A -30: DELINQUENT ACCOUNTS: Water charges billed shall
become delinquent on the due date. Delinquent accounts shall be
processed in accordance with the billing policy adopted by
resolution of the City Council.
3- 3A -31: UTILITY BOARD ESTABLISHED: There is hereby a board
established and appointed by the Mayor of the City of Caldwell to
hear requests for variances to established policies adopted by
Resolution of the City Council, and to request billing
adjustments. The board shall inform the consumer of the right to
appeal adverse decisions pursuant to The City of Caldwell
Contested Hearing Procedures Ordinance.
3- 3A -32: SERVICE TERMINATION: Service shall be terminated
and restored in accordance with the Billing Policy and Rate
Schedule adopted by Resolution of the City Council.
