ORDINANCE NO. 1 AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT THE OWNERS OF SAID LAND HAVE CONSENTED AND AGREED THAT SAID LAND BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 SINGLE FAMILY RESIDENTIAL ZONE; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: SECTION 1. That the following described land is contiguous and adjacent to the City of Caldwell, Idaho on the North, South and West; and that the owners of said land have requested and consented that said following described land should be annexed to the City of Caldwell, Idaho: Said property runs from Tenth Street on the west to the Dixie Drain on the east and from Jefferson Junior High School on the south to the Willowbrook Estate Subdivision on the north and is particularly described as follows: The East Half of the Southwest Quarter of the Northwest Quarter and the South Half of the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 34, Township 4 North of Range 3 West Boise Meridian, Canyon County, State of Idaho; ALSO a parcel of land in the South Half of the Northwest Quarter of the Southwest quarter of the Northwest quarter in Section 34, Township 4 North, Range 3 West Boise Meridian, Canyon County, State of Idaho, particularly described as follows: ORDINANCE #1932 p.1 Commencing at the Northwest corner pf the South Half of the Northwest Quarter of the Southwest Quarter of the Northwest quarter, Section 34, Township 4 North, Range 3 West, Boise Meridian; thence 50 feet East along the North boundary of said tract of land to the real point of beginning; thence South and parallel to the West boundary of said tract a distance of 150 feet; thence East and parallel to the North boundary thereof a distance of 110 feet; thence South and parallel to the West boundary thereof a distance of 18 feet; thence East and parallel to the North boundary thereof a distance of 130 feet; thence North and parallel to the West boundary thereof a distance of 168 feet; thence West along the North boundary thereof a distance of 240 feet to the point of beginning. Together with all water, water rights, ditches and rights of way for ditches appurtenant thereto or in anywise appertaining. TOGETHER WITH all water and water rights, ditches and rights of way for ditches thereunto belonging; EXCEPTING THEREFROM all that part of the Southeast Quarter of the Southwest Quarter of the Northwest Quarter of Section 34, Township 4 North, Range 3 West, Boise Meridian, which lies South and West of the center line of the right -of -way of the Caldwell High Line Canal as now located thereon. Together with all water and water rights, ditches and rights of way for ditches thereto belonging; ALSO EXCEPTING, beginning at the Northeast corner of the Southwest Quarter of the Southwest Quarter of the Northwest Quarter of Section 34, Township 4 North, Range 3 West, Boise Meridian, and running thence South on the East boundary line of said Southwest quarter of the Southwest Quarter of the Northwest Quarter a distance of 268 feet; thence running Northwesterly to a point in the North boundary line of said Southwest Quarter of the Southwest Quarter of the Northwest Quarter, 115 feet West of the point of beginning; thence East on said North boundary line a distance of 115 feet to the point of beginning; The annexed parcel shall include areas to the centerline of Tenth Avenue. SECTION 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the land described above by property legal description is hereby declared to be a part of the City of Caldwell, Canyon County, Idaho. SECTION 3. It is further declared that said land described above shall hereby be made part of the R -1 Single Family Residential Zone. ORDINANCE #1932 p.2 •eI sf o f , • SECTION The land described in this ordinance shall be added to the official City maps by the City Engineer and shall be subject to taxation as other property and persons within the corporate limits of the City of Caldwell, Canyon County, Idaho, upon filing of a certified copy of this ordinance with the County Recorder and County Assessor of the County of Canyon, State of Idaho, and the State Tax Commission, State of Idaho.
