HomeMy WebLinkAboutORD 1917BILL NO. 27 ORDINANCE NO. 1917 AN ORDINANCE TO AMEND TITLE IV, CHAPTER 24, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO BARTENDERS BY ADDING CERTAIN LANGUAGE IN SECTION 2 REGARDING QUALIFICATIONS AND CHANGING LANGUAGE IN SECTION 8 REGARDING FEES: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Title IV, Chapter 24 of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended by adding certain language in Section 2 pertaining to Qualifications and by changing certain language in Section 8 pertaining to Fees as follows: 4 -24 -1: QUALIFICATIONS: The applicant shall comply with all statutorily required conditions to tend bar as shall be established by the State of Idaho. In addition, the applicant shall verify to the City at the time of application for a bartender's permit that he has fully reviewed the statutes affecting the sale of alcoholic beverages as established in the Caldwell City ordinance and has reviewed the provisions of the Idaho Code affecting the sale of alcoholic beverages. The applicant shall promote compliance with the laws and regulations to insure the protection, welfare and safety of Caldwell citizens. Any violation of this provision may result in the immediate revocation of the individual's bartender permit. No license will be issued to anyone who has: 0 • 1. bee convicted and /or been gr anted a withheld judgement for the violation of any crime that is defined as a felony in the jurisdiction in which the judgeme was e within fiv (5) years prior to the date of the maki of the applicat for license; and /or who ha s n pai the fine and /or completed any se ntence whether by c onfinement , probation and /or parol for any sa felony 2. been convicted of the violat of any law of th e State, or of the United S tates regulations, go verning or prohibiting the sale o alc beverages or intoxica liquor, or has within two (2) y forfeited or suffere t he forfeiture of a bond fo r his appearance to answer char to any such violation; 3. been convicted of any crime that is defined as a e 0 4 -24 -8: FEES: The annual fee for a bartender's license is five dollars ($5.00). This fee shall not be prorated and an applicant will pay for the full year in which he makes application for a bartender's license. Said bartender's permit shall expire on December 31 of the year it is issued. Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
