ORDINANCE NO. 1909
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT THE OWNERS OF SAID LAND HAVE
CONSENTED AND_. AGREED THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R -1 SINGLE FAMILY RESIDENTIAL
ZONE; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY
ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO;
SECTION 1. THAT THE FOLLOWING DESCRIBED LAND IS CONTIGUOUS AND
ADJACENT TO THE CITY OF CALDWELL, IDAHO; AND THAT THE OWNERS OF
SAID LAND HAVE REQUESTED AND CONSENTED THAT SAID FOLLOWING
DESCRIBED LAND SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO:
SAID PROPERTY LOCATED GENERALLY AT THE SOUTHEAST CORNER OF
MONTANA AVENUE AND LARCH STREET (3505 SOUTH MONTANA) AND IS MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF THE NORTH HALF OF
THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE
SOUTHEAST QUARTER (N 112 SW 114 NW 114 SE 1/4); THENCE
RUNNING SOUTH ALONG THE WEST BOUNDARY LINE OF SAID
NORTH HALF OF THE SOUTHWEST QUARTER OF THE NORTHWEST
QUARTER OF THE SOUTHEAST QUARTER (N 1/2 SW 1/4 NW 1/4
SE 1/4) A DISTANCE OF 122.35 FEET; THENCE AT RIGHT
ANGLES EAST A DISTANCE OF 267 FEET; THENCE NORTH AT
RIGHT ANGLES A DISTANCE OF 122.35 FEET MORE OR LESS TO
THE NORTH LINE OF SAID NORTH HALF OF THE SOUTHWEST
QUARTER OF THE NORTHWEST QUARTER OF THE SOUTHEAST
QUARTER (N 1/2 SW 1/4 NW 1/4 SE 1/4); THENCE ALONG
SAID NORTH LINE A DISTANCE OF 267 FEET MORE OR LESS TO
THE POINT OF BEGINNING, ALL BEING IN SECTION 34,
TOWNSHIP 4 NORTH, RANGE 3 WEST OF THE BOISE MERIDIAN.
THE ANNEXED PARCEL SHALL INCLUDE TO THE CENTERLINE OF MONTANA
AVENUE.
SECTION 2. IT IS HEREBY DECLARED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, IDAHO, THAT THE LAND DESCRIBED ABOVE BY
PROPERTY LEGAL DESCRIPTION IS HEREBY DECLARED TO BE A PART OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHI7.
SECTION 3. IT IS FURTHER DECLARED THAT SAID LAND DESCRIBED ABOVE
SHALL HEREBY BE MADE PART OF THE R -1 SINGLE FAMILY RESIDENTIAL
ZONE.
SECTION 4. ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH ARE HEREBY REPEALED, RESCINDED AND ANNULLED.

SECTION 5. THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION, ACCORDING TO
LAW.
SECTION 6. THE LAND DESCRIBED IN THIS ORDINANCE SHALL BE ADDED
TO THE OFFICIAL CITY MAPS BY THE CITY ENGINEER AND SHALL BE
SUBJECT TO TAXATION AS OTHER PROPERTY AND PERSONS WITHIN THE
CORPORATE LIMITS OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO,
UPON FILING OF A CERTIFIED COPY OF THIS ORDINANCE WITH THE COUNTY
RECORDER AND COUNTY ASSESSOR OF THE COUNTY OF CANYON, STATE OF
IDAHO, AND THE STATE TAX COMMISSION, STATE OF IDAHO.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, THIS 1st DAY OF
july 1p 1991.
