HomeMy WebLinkAboutORD 1905BILL NO. 15 ORDINANCE NO. 1905 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO FROM C -3 (SERVICE COMMERCIAL) TO A COMBINATION OF C -2 (COMMUNITY COMMERCIAL), R -3 (MULTI - FAMILY HIGH DENSITY RESIDENTIAL) AND R -1 (SINGLE FAMILY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS C -2, R -3 AND R -1 ON THE OFFICIAL ZONING MAP IN ACCORDANCE WITH THE ATTACHED EXHIBIT A WHICH IS MADE PART OF THIS ORDINANCE, AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO; WHEREAS, IT HAS BEEN DETERMINED BY THE CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO, UPON RECOMMENDATIONS OF THE PLANNING AND ZONING COMMISSION AND FOLLOWING THE PUBLIC HEARING PROCEDURES AS REQUIRED IN SECTION 6 -4 -3 CALD WELL CODE_, THAT THE FOLLOWING DESCRIBED PROPERTY BE REZONED FROM C -3 (SERVICE COMMERCIAL) TO A COMBINATION OF C -2 (COMMUNITY COMMERCIAL), R -3 (MULTI- FAMILY HIGH DENSITY RESIDENTIAL) AND R -1 (SINGLE FAMILY RESIDENTIAL) AND 'THAT SAID REZONING IS IN 'THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO. 1. THAT PORTION OF LOT 4, LOCATED GENERALLY AT THE SOUTHEAST CORNER OF LAKE AVENUE AND USTICK ROAD WITH A DIMENSION OF APPROXIMATELY 200 FEET BY 200 FEET AND AS SHOWN ON EXHIBIT A FROM C -3 (SERVICE COMMERCIAL TO C-2 (COMMUNITY COMMERCIAL). 2. THAT PORTION OF LOT 4, LOCATED GENERALLY ON THE SOUTH SIDE OF USTICK ROAD 200 FEET EAST OF LAKE AVENUE WITH A DIMENSION OF APPROXIMATELY 200 FEET BY 800 FEET AND AS SHOWN ON EXHIBIT A FROM C -3 (SERVICE COMMERCIAL) TO R-3 (MULTI- FAMILY HIGH DENSITY RESIDENTIAL). 3 • THAT PORTION OF LOT 4, LOCATED GENERALLY ON THE EAST SIDE OF LAKE AVENUE 200 FEET SOUTH OF USTICK ROAD WITH A DIMENSION OF APPROXIMATELY 1150 FEET BY 1255 FEET AND AS SHOWN ON EXHIBIT A FROM C -3 (SERVICE COMMERCIAL) TO R -1 (SINGLE FAMILY RESIDENTIAL). 0 9 IT IS HEREBY ORDAINED AS FOLLOWS: SECTION 1. THAT CERTAIN LAND DESCRIBED ABOVE I; NOW ZONED C -2 (COMMUNITY COMMERCIAL), R -3 (MULTI - FAMILY HIGH DENSITY RESIDENTIAL) AND R -2 (SINGLE FAMILY RESIDENTIAL) AFTER THE DATE OF THIS ORDINANCE. SECTION 2. THE PLANNING, AND ZONING DIRECTOR OF THE CITY OF CALDWELL IS HEREBY INSTRUCTED TO SO DESIGNATE THE SAME ABOVE DESCRIBED PROPERTY ON THE OFFICIAL ZONING MAP OF THE CITY OF CALDWELL, IDAHO, AS BEING C -2, R -3 AND R-1. SECTION 3. ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH ARE HEREBY REPEALED, RESCINDED AND ANNULLED. SECTION 4. THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, THIS --L --DAY OF Ju , 1991.
