ORDINANCE NO. 1872
AN ORDINANCE CHANGING THE COMPREHENSIVE PLAN DESIGNATION OF
CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM
MEDIUM DENSITY RESIDENTIAL (7 to 9 DWELLING UNITS PER ACRE)
TO HIGH DENSITY RESIDENTIAL (10 TO 30 DWELLING UNITS PER
ACRE); DETERMINING THAT SAID CHANGE TO THE COMPREHENSIVE PLAN
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO;
INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE
SAID PROPERTY AS HIGH DENSITY RESIDENTIAL ON THE CITY'S
OFFICIAL COMPREHENSIVE PLAN MAP; AND REPEALING ALL LAWS,
ORDINANCES AND REOSLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of
Caldwell, Idaho:
WHEREAS, It has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendations of the Planning and
Zoning Commission pursuant to Section 6/1/7, Caldwell Code and
following the public hearing procedures as required in Section 6/
4/3, Caldwell Code, that the following described property be
redesignated from Medium Density Residential to High Density
Residential on the City's Comprehensive Plan, and that said
change to the Comprehensive Plan is in the best interest of the
City of Caldwell, Idaho;
A part of Government Lot 3, Section 15, Township 4 North,
Range 3 West of the Boise Meridian in Canyon County, Idaho,
more particularly described as follows:
COMMENCING at the Southeast corner of Government Lot 3,
Section 15, Township 4 North, Range 3 West of the Boise
Meridian, the INITIAL POINT; thence South 89 0 23' West 460.1
feet along the South line of the said Government Lot 3 to the
southwest corner thereof, which corner is on the Easterly
bank of the Boise River; thence meandering along the said
Easterly bank North 0 0 34' West 953.8 feet; thence North 12
37 West 374.9 feet to the Northwest corner of the
aforesaid Government Lot 3; thence North 89 1 17 1 30" East 59.5
feet along the North line of the said Government Lot 3 to a
point on the Southwesterly right of way line of Plymouth
Street; thence South 22 0 07 1 30" East, 1214.2 feet along the
said Southwesterly right of way line to a point of curve;
thence curving to the left along a curve having a radius of
0 0 1
805 feet and a chord bearing South 2540 East 80.1 feet
to a point in the East line of the aforesaid Government Lot
3; thence South 0"01 West, 118.4 feet to the INITIAL
POINT.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1. That certain land described above is now
designated as High Density Residential (10 to 30 dwelling units
per acre) on the City's Comprehensive Plan after the date of this
ordinance.
Section 2. The Planning and Zoning Director of the City of
Caldwell is hereby instructed to so designate the same above
described property on the Official Comprehensive Plan of the City
of Caldwell, Idaho, as being High Density Residential (10 to 30
dwelling units per acre).
Section 3. All ordinances, resolutions, orders, or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 4. This ordinance shall be in full force and effect
from and after its passage.
PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this
4th day of September, 1990.
APPROVED BY THE MAYOR of the City of Caldwell, Idaho, this
4th day of September, 1990.
