ORDINANCE NO. 1855
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND THE CITY
COUNCIL INTEND TO SELL THE FOLLOWING DESCRIBED REAL PROPERTY
OWNED BY THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; AND WHICH
SAID PROPERTY SITUATED IN CANYON COUNTY, IDAHO; THAT SAID SALE
IS MADE UNDER THE PROVISIONS OF TITLE 50, CHAPTER 14, IDAHO CODE;
THAT SAID SALE OF SAID PROPERTY SHALL BE AT PUBLIC AUCTION AND
SHALL BE SOLD TO THE HIGHEST BIDDER AND THAT NO BID SHALL BE
ACCEPTED FOR LESS THAN THE APPRAISED VALUE; SAID PROPERTY BEING
DESCRIBED AS FOLLOWS:
1. THE EASTERLY PORTION OF VACANT PARK SITE CONSISTING OF THAT
PORTION OF BLOCK 68, DEVER'S ADDITION SOUTH OF MARBLE FRONT
ROAD AND NORTHWEST OF NINTH AVENUE LESS THE FOLLOWING
DESCRIBED TRACT OF LAND:
A TRACT OF LAND COMMENCING AT THE EASTERLY CORNER OF BLOCK
67 OF SAID DEVER'S ADDITION TO CALDWELL, SAID POINT BEING
MARKED BY A STEEL PIN, THENCE NORTH 46 - 49" - 00" WEST A
DISTANCE OF 50.00 FEET TO A SET STEEL PIN, THENCE NORTH 43 -
09' - 45" EAST A DISTANCE OF 40.00 FEET TO A SET STEEL PIN
ON THE CENTERLINE OF JOLIET STREET, THENCE ALONG SAID
CENTERLINE OF JOLIET STREET NORTH 46 - 49' - 00" WEST A
DISTANCE OF 38.08 FEET TO A SET STEEL PIN, THENCE LEAVING

OR LESS, SUBJECT TO ALL EXISTING EASEMENT AND RIGHTS - OF -WAY.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO:
SECTION 1. THAT THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO, HEREBY INTEND TO SELL AT PUBLIC AUCTION THE PREVIOUSLY
DESCRIBED REAL PROPERTY SITUATED WITHIN CANYON COUNTY, IDAHO.
SECTION 2. THAT THE ORDINANCE FOR THE SALE OF SAID ABOVE
DESCRIBED REAL PROPERTY WILL BE CONSIDERED UNDER A SUSPENSION OF
THE REQUIREMENTS THAT AN ORDINANCE BE READ ON THREE DIFFERENT
DAYS AT A MEETING OF THE COUNCIL OF THE CITY OF CALDWELL, IDAHO,
AND THAT A PUBLIC HEARING WILL BE HELD ON THE 16TH DAY OF JULY,
1990, AT THE HOUR OF SEVEN THIRTY (7:30) P.M. A T THE COUNCIL
CHAMBERS IN THE CITY HALL IN THE CITY OF CALDWELL, IDAHO, WHEN
AND WHERE, OR PRIOR TO SAID DATE, ANY CITIZEN OF THE CITY OF
CALDWELL, IDAHO, OR ANY NUMBER OF CITIZENS MAY EXPRESS
DISSATISFACTION WITH QUESTION OF WHETHER OR NOT THE REAL PROPERTY
SHALL BE SOLD.

SECTION 3. THE SAID ABOVE DESCRIBED PROPERTY SHALL BE SOLD AT A
PUBLIC AUCTION TO THE HIGHEST BIDDER AND NO BID SHALL BE ACCEPTED
FOR LESS THAN THE APPRAISED PRICE AND THE CITY COUNCIL MAY REJECT
ANY AND ALL BIDS.
SECTION 4. NOTICE OF THE FOREGOING WILL BE GIVEN TO ALL CITIZENS
OF THE CITY OF CALDWELL, IDAHO, IN THREE ISSUES THEREOF PUBLISHED
ON JUEN 18, JUNE 25, AND JULY 2, 1990.
SECTION S. THAT THIS ORDINANCE SHALL BE IN FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION.
