ORDINANCE NO. 1854
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND THE CITY
COUNCIL INTEND TO SELL THE FOLLOWING DESCRIBED REAL PROPERTY
OWNED BY THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; AND WHICH
SAID PROPERTY IS SITUATED IN CANYON COUNTY, IDAHO; THAT SAID SALE
IS MADE UNDER THE PROVISIONS OF TITLE 50, CHAPTER 14, IDAHO
CODE; THAT SAID SALE OF SAID PROPERTY SHALL BE AT PUBLIC AUCTION
AND SHALL BE SOLD TO THE HIGHEST BIDDER AND THAT NO BID SHALL BE
ACCEPTED FOR LESS THAN THE APPRAISED VALUE; SAID PROPERTY BEING
DESCRIBED AS FOLLOWS:
A portion of the easterly one -half of the vacated Joliet Street
right -of -way between North Ninth Avenue and the intersection of
North Illinois Avenue and Marble Front Road; and
A westerly portion of vacant park site, Block 68, Dever's
Addition fronting on Marble Front Road and the vacated Joliet
Street right -of -way more particularly described as follows:
A tract of land commencing at the easterly corner of Block 67 of
said Devers Addition To Caldwell, said point being marked by a
steel pin, thence North 46 - 49' - 00" West a distance of 50.00
feet to a set steel pin, thence North 43 - 09' - 45" East a
distance of 40.00 feet to a set steel pin on the centerline of
Joliet Street, thence along said centerline of Joliet Street
North 46 - 49' - 00" West a distance of 38.08 feet to a set
steel pin, said pin being the POINT OF BEGINNING.
Thence continuing North 46 - 49' - 00" West a distance of
255.50 feet along said centerline of Joliet Street to a
point on a curve, said curve being nontangent to this line,
Thence northeasterly a distance of 20.37 feet along the arc
of a circular curve concave southeasterly, said curve having
a central angle of 38 - 54' - 48 ", a radius of 30.00 feet, a
chord bearing of North 67 - 08' - 28" East, a chord distance
of 19.99 feet to a set steel pin marking the point of
tangency,
Thence North 86 - 35' - 52" East a distance of 51.58 feet
along the southerly right -of -way of Marble Front Road to a
point on the northwesterly line of Block 68 of said Devers
Addition To Caldwell,
Thence South 43 - 09' - 45" West a distance of 15.73 feet
along said northwesterly line of Block 68 to the westerly
corner thereof,
Thence South 46 - 49" - 00" East a distance of 173.83 feet
along the southwesterly line of said Block 68 to a point,
Thence South 00 - 25" - 17" East a distance of 55.24 feet to
the POINT OF BEGINNING.

The above described tract of land contains 0.209 acres, more or
less, subject to all existing easements and rights -of -way; and
A tract of land commencing at the easterly corner of Block 67 of
said Devers Addition To Caldwell, said point being marked by a
steel pin, thence North 46 - 49" - 00" West a distance of 50.00
feet to a set steel pin, thence North 43 - 09' - 45" East a
distance of 40.00 feet to a set steel pin on the centerline of
Joliet Street, thence along said centerline of Joliet Street
North 46 - 49' - 00" West a distance of 38.08 feet to a set steel
pin, thence leaving said centerline North 00 - 25' - 17" West a
distance of 55.24 feet to a point on the southwesterly line of
Block 68, said point being the POINT OF BEGINNING.
Thence along the southwesterly line of Block 68
North 46 - 49' - 00" a distance of 173.83 feet to the
westerly corner thereof,
Thence North 43 - 09' - 45" East a distance of 15.73 feet
along the northwesterly line of Block 68 to a point on the
southerly right -of -way of Marble Front Road,
Thence North 86 - 35" - 52" East a distance of 115.18 feet
along the said southerly right -of -way of Marble Front Road
to a set steel pin,
Thence South 00 - 25' - 17" East a distance of 137.27 feet
to the POINT OF BEGINNING.
The above described tract of land contains 0.213 acres, more or
less, subject to all existing easements and rights -of -way.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and Council of the City of Caldwell,
Idaho, hereby intend to sell at public auction the previously
described real property situated within Canyon County, Idaho.
Section 2. That the ordinance for the sale of said above
described real property will be considered under a suspension of
the requirments that an ordinance be read on three different days
at a meeting of the Council of the City of Caldwell, Idaho, and
that a public hearing will be held on the 18th day of June, 1990,
at the hour of seven thirty (7:30) p.m. at the Council Chambers
in the City Hall in the City of Caldwell, Idaho, when and where,
or prior to said date, any citizen of the City of Caldwell,
Idaho, or any number of citizens may express dissatisfaction with
said sale as set forth in Section 50 -1203, Idaho Code wherein it
is provided that if a petition expressing dissatisfaction with
said sale containing the names of qualified electors of the City
in a number equal to ten percent (10%) of the toal votes cast for
Mayor at the preceding City election is filed with the City Clerk
during sixty (60) days from the passage of this ordinance, the
City Council shall cause a special election to be held on the

question of whether or not the real property shall be sold.
Section 3. The said above described property shall be sold at a
public auction to the highest bidder and no bid shall be accepted
for less than the appraised price and the City Council may reject
any and all bids.
Section 4. Notice of the foregoing will be given to all citizens
of the City of Caldwell, Idaho, in three issues thereof published
on May 21, May 28 and June 4, 1990.
Section 5. That this ordinance shall be in force and effect from
and after its passage, approval and publication.
