HomeMy WebLinkAboutORD 1848BILL NO. 12 ORDINANCE NO. 1548 AN ORDINANCE TO AMEND TITLE VI, CHAPTER 2, SECTION 1, TABLE 2, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO ZONING DISTRICT REGULATIONS BY ADDING CERTAIN LANGUAGE IN TABLE 2 REGARDING HEIGHT, SETBACK AND AREA SCHEDULE: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho, County of Canyon, State of Idaho: Section 1. That Title VI, Chapter 2, Section 1, Table 2, of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended by adding certain language in Section 1, Table 2 as follows: TABLE 2 HEIGHT, SETBACK AND AREA SCHEDULE 0+ Minimum Setback Yard Requirements (in feet) (1) The minimum lot area for each dwelling unit above that required for two - family dwellings shall be one thousand five hundred (1,500) square feet for each additional unit unless the lot area is permitted to be reduced by special permit procedures in the case of high rise and similar development proposals. (2) The maximum height may be exceeded by special permit. (3) Residential uses shall have the same requirements as set forth in the R -3 Zone. When commercial and industrial uses abut a residential zone, setbacks shall be the same as are required in Maximum Min. Inter. Min.Corner Height Interior St. Lot Area Lot Area District (in ft.) When residences are located in commercial and industrial zones, setback requirements are the same as for residential zones. (6) Refer also to supplementary setback prov isions in Sections 6- 3 -1(D) and 6 -3 -2 of this Title. (Ord. 1451, 12- 13 -77; and Ord. 1503, 8- 15 -78) Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
