ORDINANCE NO. 1838
AN ORDINANCE FOR THE CITY OF CALDWELL, A MUNICIPAL
CORPORATION OF IDAHO, CREATING A NEW SECTION, TITLE II,
CHAPTER 14, SECTION 1 THROUGH 5 WITH REGARD TO CALDWELL
IRRIGATION COMMISSION: PROVIDING FOR THE CREATION OF THE
CALDWELL IRRIGATION COMMISSION; MEMBERS; TERMS OF OFFICE;
ORGANIZATION, AND DUTIES.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Municipal Code of the City of
Caldwell be amended to add a new Chapter 14, Title II, Section 1
through 5 establishing a Caldwell Irrigation Commission as
follows:
2 -14 -1: COMMISSION CREATED: There is hereby created and
established a Commission to be known as "Caldwell
Irrigation Commission ".
2 -14 -2: MEMBERSHIP: The Caldwell Irrigation Commission shall
consist of
eight members
appointed by
the Mayor and
confirmed
by the Members
of the City
Council. The
Commission
membership shall
also include
two ex officio
members: A member of the Engineering Staff and the
Irrigation Superintendent.
2 -14 -3: TERMS OF OFFICE: Initial appointments to the Commission
shall be made as follows: Two one (1) year terms; two
two (2) year terms; two three (3) year terms; and two
four (4) year terms. All subsequent appointments shall
be made for four (4) year terms.
2 -14 -4: ORGANIZATION: The Commission shall meet monthly on the
second Thursday at 4:30 p.m. in the Council Chambers.
The Commission shall elect officers from among the
Commission members. The Chairman shall preside at
meetings of the Commission. The Vice Chairman shall, in
the absence of the Chairman, perform the duties of the
Chairman. All meetings of the Commission shall be open
to the public and follow the requirements of Idaho's
open meeting laws. The Commission shall keep minutes
and other appropriate written records. A simple
majority of Commission members present at any given
meeting constitutes a quorum.
2 -14 -5: DUTIES: The Commission is formed for the purpose of
recommending to the Mayor and City Council projects for
the Caldwell Municipal Irrigation District which would
be in the best interest of the City of Caldwell.
Section 2. All ordinances, resolutions, orders or parts
thereof, in conflict herewith are herby repealed, rescinded and
annulled.
Section 3. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
