HomeMy WebLinkAboutORD 1834a BILL NO. 34 ORDINANCE NO. 1834 i AN ORDINANCE TO AMEND TITLE VIII, CHAPTER 1, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO SIDEWALKS BY DELETING AND ADDING LANGUAGE IN SECTION 1, REGARDING MAINTENANCE RESPONSIBILITY; SECTION 2 REGARDING COUNCIL DIRECTED REPAIRS; AND ADDING SECTION 8 REGARDING REMOVAL OF SNOW, ICE, RUBBISH, DEBRIS, AND WEEDS: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho, County of Canyon, State of Idaho: Section 1. That Title VIII, Chapter 1 of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended by deleting and adding certain language in Section 1, Section 2, and adding Section 8 pertaining to responsibilities regarding sidewalks as follows: 8 -1 -1: PROPERTY OWNER MUST CONSTRUCT, REPAIR AND MAINTAIN SIDEWALKS: It shall be the duty and responsibility of every property owner construct, repair and maintain in a safe, non - hazardous condition any sidewa on City streets that front the property which he or she owns. 8 - 1 - 2: COUNCIL DIRECTED REPAIRS: InT• e "' ' ' slha11 The Council may deem any sidewalk on any of the City streets unsafe or dangerous. It may, by Resolution passed by a two - thirds (2/3) majority of all the members elected to the Council, order such sidewalk replaced or repaired and assess the cost and expense of replacing or repairing same against the property in front of which the same shall be replaced or repaired. a i 8 -1 -8: REM OVAL OF SNOW, ICE, RUBBISH, DEBRIS AND WEEDS: It sha be the duty and responsibi of ev ery property owner to clear all i ce, snow, rubbish debris and weeds from sidewalks along City streets that front the property which he or she owns. Snow and ice shall be removed in a timely manner following a storm, but shall not be piled so that it obstructs the travel lanes of the street or sidewalk; nor shall snow removed from private Parking areas be filed upon City rights of way or on private property from which permission has not been obtained. Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law. day of PASSED BY THE CITY COUNCIL of the City of Caldwell this 6th November , 1989.
