AN ORDINANCE RECITING PETITION FOR VACATION, RECITING APPROPRIATE
NOTICE THEREFOR WAS GIVEN, AND DETERMINING THAT VACATION OF THE
SOUTH 4 FEET OF THE 16 -FOOT UTILITY AND DRAINAGE EASEMENTS ON THE
FOLLOWING - DESCRIBED REAL PROPERTY IS IN THE BEST PUBLIC INTEREST
FOR THE CITY OF CALDWELL, IDAHO:
Lots 1 and 16, Block 4 of Sylvan Manor Subdivision, the
official plat of which is on file and of record in the office
of the Recorder of Canyon County, Idaho, more particularly
described as follows:
Commencing at the Northwest corner of Lot 1, Block 4, of said
Sylvan Manor Subdivision; thence South along the West line of
said Lot 1, a distance of 12.00 feet to the POINT OF
BEGINNING; thence East on a line parallel with the North line
of said Lot 1, a distance of 110.17 feet; thence South on a
line parallel with the East line of said Lot 1, a distance of
4.00 feet; thence West and parallel with said North line, a
distance of 110.17 feet to the West line of said Lot 1;
thence North along said West line, a distance of 4.00 feet to
the POINT OF BEGINNING; and also,
Commencing at the Northeast corner of Lot 16, Block 4 of said
Sylvan Manor Subdivision; thence South along the East line of
said Lot 16, a distance of 12.00 feet to the POINT OF
BEGINNING; thence West on a line parallel with the North line
of said Lot 16, a distance of 110.00 feet; thence South on a
line parallel with the West line of said Lot 16, a distance
of 4.00 feet; thence East on a line parallel with said North
line, a distance of 110.00 feet to the East line of said Lot
16; thence North along said East line, a distance of 4.00
feet to the POINT OF BEGINNING.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That a petition has been received by the Mayor
and Council of the City of Caldwell, Idaho, requesting passage and
approval of an ordinance vacating the south 4 feet of the 16 -foot
drainage and utility easements described above located in
Caldwell, Canyon County, Idaho; that statutory notice has been
given to citizens and owners of property and a public hearing held
on May 1, 1989, pursuant to Section 50- 1306A, Idaho Code; that no
objections to said vacation were recorded at said hearing.
Section 2. That it is hereby determined it is in the best
public interest that a portion of the above- described utility and
drainage easements be vacated.
Section 3. Be it ordained and established that the south 4
feet of the 16 -foot utility and drainage easements as described
above in the City of Caldwell, Canyon County, Idaho, shall be
vacated and shall no longer be subject to the use of the public;

and thereupon title to said portion of easements in the City of
Caldwell, County of Canyon, State of Idaho, above- described, shall
pass and revert to the persons dedicating the same, or their
successors, heirs and assigns in the manner in which they were so
dedicated.
Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this
