HomeMy WebLinkAboutORD 1810i BILL NO. 10 ORDINANCE NO. 1810 AN ORDINANCE TO AMEND TITLE VII OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY ADDING THE FOLLOWING WHICH WILL BE DESIGNATED AS CHAPTER 6 OF SAID TITLE VII REGARDING APPEARANCE OF COMMERCIAL BUILDINGS: PROVIDING RESPONSIBILITY OF PROPERTY OWNERS; CITY MAY CAUSE CLEAN UP OF REFUSE AND CHARGE AGAINST PROPERTY; PENALTY FOR VIOLATION: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That Title VII of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended by adding the following which shall be designated as Chapter 6 of said Title VII of said City Code: 7 -6 -1: RESPONSIBILITY OF PROPERTY OWNERS: All property owners owning property within C -1, C -2, C -3, or C -4 Zoning shall be required to keep all structures in a neat, orderly and clean condition. Accumulation of debris and dirt on or about the building shall be prohibited. Any portion, feature or attachment to the building in a state of disrepair or uncleanliness shall be removed, replaced or cleaned. Landscaping put in voluntarily by the property owner around or in front of the building shall be maintained by the property owner. Dead or dying landscaping shall be removed immediately. 7 -6 -2: CITY MAY CAUSE CLEAN UP OF REFUSE AND CHARGE AGAINST PROPERTY: The Mayor or the City Council, after five (5) days notice, may cause the removal, disposal or cleaning of debris, dirt, unmaintained features or landscaping as often as necessary on commercial buildings or property not in compliance. 7 -6 -3: PENALTY FOR VIOLATIONS: Any person owning, managing, or occupying any lots, lands or premises within such incorporated limits of the City who shall, after notice, fail, refuse or neglect to continuously keep the property they control free from refuse in a manner prescribed in Section 1 may be cited by the Building Official or his designee for violation of this Code Provision. Violation of said Code Provision shall be a misdemeanor with a minimum fine of $300. In addition to the above criminal penalties, should the City i • cause removal and disposal of refuse or other items as often as necessary on lots, lands, or premises not in compliance, such work shall be billed and paid at 200$ of actual expense to the property owner involved. The Court shall order payment to the City of the above cost as a condition of any probation granted in a criminal proceeding. Failure of a Defendant to pay within the prescribed period may be enforced by the City within the Courts. Section 2. That all ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
