ORDINANCE NO. 1806
AN ORDINANCE TO AMEND TITLE IX OF THE MUNICIPAL CODE OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY ADDING
THE FOLLOWING WHICH WILL BE DESIGNATED AS CHAPTER 11 OF SAID
TITLE IX REGARDING CURFEW: PROVIDING CHILDREN ON THE STREETS
AT NIGHT; CHILDREN WHO ARE SIXTEEN AND SEVENTEEN YEARS OLD ON
STREETS AT NIGHT; AND PERMITTING CHILDREN TO VIOLATE CURFEW:
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That Title IX of the Municipal Code of the City
of Caldwell, County of Canyon, State of Idaho, shall be amended
by adding the following which shall be designated as Chapter 11
of said Title IX of said City Code:
9 -11 -1: CHILDREN ON THE STREET AT NIGHT: It shall be
unlawful for any person under sixteen (16) years of age to remain
or loiter upon any street or alley or other public place in the
City between the hours of twelve o'clock (12:00) p.m. and five
o'clock (5:00) a.m., unless such person is accompanied by a
parent or guardian or other person having custody of such minor
or unless in the performance of a duty directed by such parent,
guardian, or other person having custody or unless such person is
in lawful employment, making it necessary to be in such place
between the hours of twelve o'clock (12:00) p.m. and five o'clock
(5:00) a.m., or unless such person is lawfully traveling to and
from a place of employment or a lawful social activity.
9 -11 -2: CHILDREN WHO ARE SIXTEEN AND SEVENTEEN YEARS OLD ON
STREETS AT NIGHT: It shall be unlawful for any minor child from
the age of sixteen (16) years to, but not including, eighteen
(18) years, to remain or loiter upon any street or alley or other
public place in the City between the hours of one o'clock (1:00)
a.m. and five o'clock (5:00) a.m., unless such person is
accompanied by a parent or guardian or other person having
custody of such minor or unless in the performance of a duty
directed by such parent, guardian, or other person having custody
or unless such person is in lawful employment, making it
necessary to be in such place between the hours of one o'clock
(1:00) a:m. and five o'clock (5:00) a.m., or unless such person
is lawfully traveling to and from a place of employment or a
lawful social activity.
9 -11 -3: PERMITTING CHILDREN TO VIOLATE CURFEW: It shall be
unlawful for anyone having the legal care and custody of any
person as described above to allow or permit such person to
remain or loiter upon any public street, alley, or any other
public place in the City in the night time as restricted in the
preceding Section except in case of necessity.
Section 2. That all ordinances or parts of ordinances
inconsistent herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
