ORDINANCE NO.
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO FROM R -1 SINGLE FAMILY RESIDENTIAL TO R -3
MULTI - FAMILY HIGH DENSITY RESIDENTIAL; DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY
AS R -3 MULTI- FAMILY HIGH DENSITY RESIDENTIAL ON THE OFFICIAL
ZONING MAP; AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and
Zoning Commission and following the public hearing procedures as
required in 6 -4 -3, Caldwell Code that the following- described
property be rezoned from R -1 Single Family Residential to R -3
Multi- family High Density Residential, and that said rezoning is
in the best interest of the City of Caldwell, Idaho:
That part of the East Half of the Southwest Quarter of the
Southwest Quarter of the Northeast Quarter of Section 28,
Township 4 North, Range 3 West of the Boise Meridian, in
the City of Caldwell, Canyon County, State of Idaho,
described as follows:
COMMENCING at the Southwest corner of the Northeast Quarter
of said Section 28; thence South 89 55' East, 330.85 feet
to the Southwest corner of the East Half of the Southwest
Quarter of the Southwest Quarter of the Northeast Quarter of
said Section 28, THE REAL POINT OF BEGINNING;
thence continue South 89 55' East, 173.15 feet; thence
North 0° 24' 30" West, 661.1 feet on a line parallel with
the West boundary of the Northeast Quarter of said Section
28 to a point in the North boundary line of said East Half
of the Southwest Quarter of the Southwest Quarter of the
Northeast Quarter;
thence North 89 55' West, 173.15 feet more or less to the
Northwest corner of said East Half of the Southwest Quarter
of the Southwest Quarter of the Northeast Quarter; thence
South 0 24' 30" East, a distance of 661.1 feet along the
West boundary of said East Half to the REAL POINT OF
BEGINNING.
The property is located in the 300 block of West Logan
Street.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1. That certain land described above is now zoned
R -3 Multi- family High Density Residential and shall be so changed
from R -1 Single Family Residential after the date of this
ordinance.
Section 2. The City Engineer of the City of Caldwell is
hereby instructed to so designate the same above- described
property on the Official Zoning Map of the City of Caldwell,
Idaho, as being R -3 Multi- family High Density Residential.
Section 3. All ordinances, resolutions, orders or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 4. This ordinance shall be in full force and effect
from and after its passage.
