ORDINANCE NO. 1803
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING
APPROPRIATE NOTICE THEREFOR WAS GIVEN, DETERMINING THAT VACATION
OF THE FOLLOWING DESCRIBED REAL PROPERTY SHALL BE 14ADE:
The West 40 feet of Brock Avenue lying between West Ash
Street and West Hazel Street as shown on the Plat of West
Ash Addition on file in Book 8 of Plats at Page 7 in the
Office of the Recorder of Canyon County, Idaho; and also,
A 10-foot parcel of land dedicated for right of way purposes
more particularly described as follows:
BEGINNING at the Northeast corner of Lot 7 of Block 3 of
said West Ash Addition; thence North 39 West, 10.00
feet; thence South 0 West, 280.00 feet to a point
which is on the North boundary line West Ash Street; thence
South 39'51 East, 10.00 feet; thence North 0 6 05145.,
East, 280.00 feet to the POINT OF BEGINNING;
AND DETERMINING THAT SAID VACATION IS IN THE BEST INTEREST OF THE
PUBLIC FOR THE CITY OF CALDWELL, IDAHO;
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That, in accordance with a notion passed by the
Council and approved by the Mayor of the City of Caldwell, Idaho,
statutory notice of public hearing has been given to citizens and
owners of property in the City of Caldwell, Idaho, as set forth
in Section 50-1306A, Idaho Code; and said public hearing has been
held on November 21, 1988, to consider an application presented
to the Mayor and Council of the City of Caldwell, Idaho,
requesting passage and approval of an ordinance vacating the
above described real property located in Caldwell, Canyon County,
Idaho. Said vacataion is subject to the reservations of all
utility companies and all existing easement rights in the area
comprising easement rights for sewer lines, water lines, power
lines, telephone lines, irrigation lines and gas lines as
presently located thereon or therein, with the further
reservation to the City of Caldwell and all utility companies
with easement rights in the area comprising said easement rights
for access to and from said area to maintain, repair or replace
the present existing sewer, water, power, telephone, irrigation
and gas lines as presently located thereon or therein.
Section 2. That it is hereby determined it is in the best
int of the public that the above - described premises in the
ORDINANCE - 1
City of Caldwell, Canyon County, Idaho, be vacated subject to
existing easement rights and further easement rights as set
forth above,
Section s. Be it ordained and established that the above-
described premises in the city of Caldwell, Canyon County, Idaho,
shall be vacated and shall no longer be open or subject to the
'
use of the public and thereupon title to said premises in the
City of Caldwell, Canyon County, Idaho, above described, shall
pass and revert one half to each adjacent property owner, subject
to existing easement rights in the area as opt forth above.
Section 4. This ordinance shall be in full force and effect
from and after its passage and publication according to law.
