AN ORDINANCE OF THE CITY OF CALDWELL, AMENDING TITLE III,
CHAPTER 3A, OF THE CALDWELL MUNICIPAL CODE, BY PROVIDING
ADDITIONAL SECTIONS 3 -3A -34 THROUGH 3- 3A -41, PROHIBITING
CROSS CONNECTIONS TO THE WATER SUPPLY SYSTEM OF THE CITY OF
CALDWELL, DECLARING SUCH CROSS CONNECTIONS TO BE A NUISANCE,
AND PROVIDING FOR THE ABATEMENT THEREOF AND PROVIDING A
PENALTY FOR THE VIOLATION OF THESE SECTIONS.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF CALDWELL, IDAHO:
Section 1. That Title III, Chapter 3A of the Caldwell
Municipal Code be amended to provide the following:
3- 3A -34: DEFINITIONS:
CROSS CONNECTION Any physical connection or
arrangement between two otherwise
separate piping systems, one of
which contains potable water and
the other any substance whereby
the potential for reverse flow
exists.
BACKFLOW
The process of reverse flow of any
substance into the City water
system caused by back pressure or
back siphonage.
AGENT
An employee of the City of
Caldwell Water Department
representing the interests of the
City of Caldwell.
CITY WATER SYSTEM
The source, pumping facilities,
storage, and transmission and
distribution system of the City of
Caldwell for providing water for
human consumption.
APPROVED DEVICE
A backflow prevention device, of
proper design, certified by the
State of Idaho Division of
Environmental Quality.
SUPERINTENDENT
The Superintendent of the Water
Department or his authorized
representative.
3- 3A -35: CROSS CONNECTIONS: City water service will not be
provided to any new user of City water until a physical
inspection by the Superintendent shows no potential cross
connections exist. Additionally, water service shall be
discontinued to any user with a potential cross connection on
their premises, until such time as the proper prevention device
is installed and tested.
3- 3A -36: USE OF BACKFLOW PREVENTION DEVICE: When deemed
necessary by the Superintendent, an approved device shall be
purchased and installed at the user's expense on the owner's
property. An annual operational test shall be conducted by the
agent or other certified backflow device tester, to insure the
effectiveness of the device. A backflow device shall be
installed whenever materials stored or processed by the user
would present a hazard to health or impair the quality of water
provided by the City water system. Activities requiring a
backflow device include, but are not limited to, the following:
a. Premises having an auxiliary water supply.
b. Premises with intricate plumbing systems which make it

difficult to determine if a cross connection exists.
C. Premises with entry restrictions making inspection for
cross connections impractical.
d. Premises with known cross connection, or a history of
cross connections.
e. Any location where process or cooling substances are
pressurized.
f. Premises where hazardous or toxic materials are handled
and the possibility of back siphonage exists.
g. Backf low prevention devices shall be installed on the
following facilities for the protection of the City water system:
1) Hospitals, clinics and mortuaries.
2) Laboratories.
3) Metal plating industries.
4) Sewage treatment facilities.
5) Food or beverage processing plants.
6) Chemical /industrial plants using a water process.
7) Petroleum storage facilities.
8) Chemical storage or distribution facilities.
9) Tank truck fill stations.
10) Car washes, and
11) Any site specified by the Superintendent or State of
Idaho as endangering the quality of the City water system.
3- 3A -37: DEGREE OF HAZARD: Minimum backflow protection
required shall conform to the following requirements:
a. An airgap separation or reduced pressure principle
device is required for hazardous or toxic applications.
b. A double check valve assembly shall be installed when an
objectionable but not hazardous substance could come into contact
with the City water system.
C. For lawn sprinkler applications, an atmospheric vacuum
breaker can be installed, provided no shut -off valves are
installed downstream from the device, or
d. A pressure vacuum breaker shall be installed when shut-
off valves are located downstream from the device.
3- 3A -38: CROSS CONNECTION INSPECTIONS:
a. Water service shall not be provided to any new structure
built until it has been inspected for cross connections and
approved by the Superintendent.
b. Periodic inspections shall be made by the agent on all
buildings where the possibility of cross connections may occur.
3- 3A -39: ADDITIONAL REMEDIES: In the event a cross
connection is discovered and not corrected within ninety (90)
days, or inspection access is refused, water service shall be
terminated until such time as the deficiency is corrected. In
addition, the agent may have the appropriate protective device
installed, at the owner's expense, and resume water service only
when all costs have been recouped.
3- 3A -40: VIOLATIONS AND PENALTIES: Any person who is found
to be guilty of violating any portion of this ordinance shall be
guilty of a misdemeanor.
3- 3A -41: SEVERABILITY: If any one or more sections or
subsections of Sections 3 -3A -34 through 3 -3A -41 are for any
reason held to be invalid or unconstitutional, such decision
shall not affect the validity of the remaining portions of this
Ordinance and the same shall remain in full force and effect.
