HomeMy WebLinkAboutORD 1800BILL NO. 30.- - ORDINANCE NO. - TbO - 1 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -2FT MEDIUM DENSITY RESIDENTIAL (MOBILE HOME AND FLOODPLAIN OVERLAY ZONES) TO C -3TF SERVICE COMMERCIAL (MOBILE HOME AND FLOODPLAIN OVERLAY ZONES); DETERMINING.THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY AS C -3TF SERVICE COMMERCIAL (MOBILE HOME AND FLOODPLAIN OVERLAY ZONES) ON THE OFFICIAL ZONING MAP; AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in 6-4 -3, Caldwell Code that the following described property be rezoned from R -2TF Medium Density Residential (Plobile Home and Floodplain Overlay Zones) to C -3TF Service Commercial (Mobile Home and Floodplain Overlay Zones) and that said rezoning is in conformance with the Comprehensive Plan for Caldwell, Idaho: SEE EXHIBIT A ATTACHED Where the boundary line follows the right of way for Elgin Street, it shall be construed as following the centerline. IT IS HEREBY ORDAINED AS FOLLOWS: Section 1. That certain land described above is now zoned C -3TF Service Commercial (Mobile Home and Floodplain Overlay Zones) and shall be so changed from R -2TF ileolum uensiLy Residential (Mobile Home and Floodplain Overlay Zones) after the date of this ordinance. Section 2. The City Engineer of the City of Caldwell is hereby instructed to so designate the same above - described property on the Official Zoning Map of the City of Caldwell, Idaho, as being C -3TF Service Commercial (Mobile Home and Floodplain Overlay Zones). ORDINANCE - 1 • Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Secion 4. This ordinance shall be in full force and effect from and after its passage.
