HomeMy WebLinkAboutORD 1797BILL No 27 ORDINANCE NO. 1797 AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE THEREFOR WAS GIVEN; DETERMINING THAT VACATION OF A PORTION OF RIVERSIDE STREET IN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, DESCRIBED BELOW, SHALL BE MADE; AND DETERMINING THAT VACATION OF SAID FOLLOWING-DESCRIBED PROPERTY IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO: The South 20 feet of Riverside Street lying between Rodeo Avenue and Roedel Avenue, as shown on the official plat of Industrial Site Addition Number Two, on file and of record in the office of the Recorder; Canyon County, Idaho, more particularly described as follows: BEGINNING at the East corner of Tract 3 of said Industrial Site Addition Number Two; thence West along the North boundary of said Tract 3, a distance of 528.9 feet; thence North along the Wost boundary extended of said Tract 3, a distance of 20 feet; thence East and parallel with the North boundary of said Tract 3, a distance of 528.9 feet; thence South along the East boundary extended of said Tract 3, a distance of 20 feet to the POINT OF BEGINNING. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That by a motion passed by the Council and approved by the Mayor of the City of Caldwell, Idaho, October 3, 1988, and statutory notice having been given to citizens and owners of property in the City of Caldwell, Idaho, in accordance with Section 5071306A, Idaho Code, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above-described real property located in Caldwell, Canyon County, Idaho. Section 2. That the City Council has made the finding that: ( the vacation of the South 20 feet of Riverside Street will enable more efficient industrial use of the adjacent property; and, (2) that access to Riverside Street is restricted on the north side because of the Riverside Canal and therefore a substandard right of way of 40 feet is adequate for fire equipment, vehicular and truck traffic, and installation of utility lines. Section 3. That it is hereby determined it is in the best interest of the public that the above-described premises in the City of Caldwell, Canyon County, Idaho, be vacated. Section 4. Be it ordained and established that the above- described premises in the City of Caldwell, Canyon County, Idaho, shall be vacated and shall no longer be open or subject to the use of the public and thereupon title to said premises in the City of ORDINANCE - 1 ' Caldwell, cmoyoo county, Idaho, above-ueoccibed, shall pass and revert | � to the persons dedicating the same or their successors, heirs and assigns in the manner in which they were so dedicated. Section 5.
