ORDINANCE NO. 1792
AN ORDINANCE TO AMEND TITLE III, CHAPTER 3A, SECTION 29(B)
PERTAINING TO WATER DEPARTMENT OF THE MUNICIPAL CODE OF THE
CITY OF CALDWELL, IDAHO, BY DELETING AND ADDING CERTAIN
LANGUAGE WITH REGARD TO DEPOSITS AND WATER TURN -ON FEES:
REPEALING ALL ORDINANCES, RESOLUTIONS OR PARTS THEREOF IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 29(B), Title III, Chapter 3A of
the Municipal Code be amended as follows:
3- 3A -29: DEPOSITS AND WATER TURN -ON FEES:
(B) The City reserves the right to require a deposit (the
deposit shall be equal to an estimated billing for a peak
billing period of the applicant). Said deposit shall be
required and paid with each application except for the
following exceptions:
1. Applicant has maintained recent good payment records
with previous City water and sewer accounts for a period of
-- one (1) year and has no outstanding unpaid
service bills.
2. Applicant presents recent certifications from at least
two (2) other utilities that
they have maintained a good payment record for a period of
one (1) year
For purposes of this Section, good payment record shall mean
applicant's service has not been terminated by any utility
without request by the applicant for one of the following
reasons: nonpayment of an account not in dispute; fraud or
misrepresentation; failure to reimburse the utility for
damages due to negligent or intentional acts of the
customer. It shall also mean that the customer has
continued to pay his account on or before the date such
payment is delinquent.
Section 2. All ordinances or parts of ordinances
inconsistent herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
