Home My WebLink AboutORD 1791• 0 BILL NO. - .21- ORDINANCE NO. —1-791 AN ORDINANCE AMENDING TITLE VI, CHAPTER 2, SECTION 6 -2 -1, TABLE 1, LAND USE SCHEDULE, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, IDAHO, TO ALLOW RECYCLING COLLECTION STATIONS AND TEMPORARY RECYCLING STATIONS IN SPECIFIED COMMERCIAL AND INDUSTRIAL ZONES IN THE CITY OF CALDWELL, IDAHO; AMENDING SECTION 6 -5 -4, DEFINITIONS, TO PROVIDE- DEFINITIONS FOR RECYCLING COLLECTION STATION AND RECYCLING COLLECTION STATION, TEMPORARY; ALSO AMENDING SECTION 6- 3 -1D3F TO REQUIRE SIGHT OBSCURING FENCES FOR SAID STATIONS WHEN ADJACENT TO RESIDENTIAL USES; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That Title VI, Chapter 5, Section 6 -5 -4, DEFINITIONS, of the Municipal Code of Caldwell, Idaho, be amended as follows: Between the definitions for PARKING SPACE and RESTAURANT, the definitions for RECYCLING COLLECTION STATION and RECYCLING COLLECTION STATION, TEMPORARY shall be added: RECYCLING COLLECTION A building used for processing STATION: recyclable materials, including collecti g; sorting compacting and tra nsfer of said materials. Recyclable materials i • nclude paper, aluminum cans; bottles; etc:; but shall not include ceiemicals or other hazardous RECYCLING COLLECTION A vehicle or movable buildin or STATION; TEMPORARY: structure where recyclable materials are collected for transfer—t a recyclin g station Section 3. That Title VI, Chapter 3, Section 6- 3- 1D,3,f,iii, of the Municipal Code of the City of Caldwell, Idaho, shall be changed as follows: (iii) The following uses are declared to require sight obscuring fences: Junk yard. Wrecking yard. Equipment or vehicle salvage storage yard. Sanitary landfill. Recycling collection stations and temporary recycling collection stations on any side which is directly adjacent to residential uses. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
