ORDINANCE NO. -- 1782
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO, FROM R-3 MULTI-FAMILY HIGH DENSITY
RESIDENTIAL TO C-3 SERVICE COMMERCIAL; DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY
AS C-3 SERVICE COMMERCIAL ON THE OFFICIAL ZONING MAP; AND
REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT
HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and
Zoning Commission and following the public hearing procedures as
required in 6-4-3, Caldwell Code, that Block 121 of Strahorn
Addition No. I to Caldwell, Idaho, the official plat of which is
on file and of record in the office of the Recorder of Canyon
County, Idaho, be rezoned from R-3 Multi-family High Density
Residential to C-3 Service Commercial, said rezoning being in
compliance with the Comprehensive Plan of the City of Caldwell
Idaho. The boundaries of the zone shall include to the
centerline of Paynter Avenue, S. 1st Avenue, Dearborn Street, S.
2nd Avenue and Everett Street. Property addresses included in
the rezoned area are: 106, i16 and 124 Dearborn Street; 109
Paynter Avenue; 117 and 123 Everett Street; and 513 S. Second
Avenue.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section i. That certain land described above is now
zoned C-3 Service Commercial and shall be so changed from R-3
Multi- family High Density Residential after the date of this
ordinance.
Section 2. The City Engineer of the City of Caldwell is
hereby instructed to so designate the same above-described
property on the Official Zoning Map of the City of Caldwell,
Idaho, as being C-3 Service Commercial.
Section 3. Ail ordinances, resolutions, orders or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 4. This ordinance shall be in full force and effect
from and after its passage.
