ORDINANCE NO. 1780
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING
APPROPRIATE NOTICE THEREFOR WAS GIVEN; DETERMINING THAT VACATION
OF CERTAIN PROPER'T'Y IN CITY VIEW 'TRACTS DESCRIBED BELOW SHALL BE
MADE, AND THAT SAID VACATION IS IN THE BEST PUBLIC INTEREST FOR
THE CITY OF CALDWELL, IDAHO.
BE IT ORDAINED BY THE MAY0R AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That a motion was passed by the Council and
approved by the Mayor of the City of Caldwell, Idaho, for
statutory notice to be given to citizens and owners of property
in the City of Caldwell, Idaho, in accordance with Section 50-
1306A, Idah Code stating that an application has been presented
to the Mayor and Council of said City of Caldwell, Idaho,
requesting passage and approval of an ordinance vacating an
unnamed street and a part of Tracts 1 and 2 in City View Tracts
on file in Book 2 of Plats at Page 9 in the office of the County
Recorder, Canyon County, Idaho, described as follows:
Parcel 1: A 40 -foot by 1,250 -foot parcel of street
right of way adjacent to Lots 1, 2, 6, 7, 8, 9, 11 and
12 of said City View Tracts, terminating at the
Southwest corner of Lot 12.
Parcel 2: All that part of Tracts 1 and 2 lying East
of the East right of way boundary of Specht Avenue, arid
lying South of the South right of way boundary of
Franklin Road and lying West of the Westerly right of
way boundary of Ramp B -C to Interstate Highway 84,
except those portions contained within the following
described parcel:
This parcel is a portion of Tracts 1, 2, 6 and 7 as
platted in said City View Tracts, and is situated in
the NIV 1/4 NE 1/4, Section 26, T4N, R3WBM, more
particularly described as follows:
COMMENCING at the Northwest corner of said NW 1/4 NE
1/4; th S 0® 09 W along the West boundary of said
NW 1/4 14E 2/4, a distance of 60.00 feet; th N 89
27 E along a line parallel with the North boundary
of said NW 1/4 NE 1/4, a distance of 40.00 feet to the
Northeast corner of Caldwell Interstate No. 1 as on
file in Book 16 of Plats at Page 8 in said office of
the Canyon County Recorder, which point is also on the
East right of way boundary of Specht Avenue; th S d®
09 West along said East right of way boundary, a
distance of 175.00 feet to the TPOB;
Thence N 89 27 E along a line parallel with said
North boundary, a distance of 417.06 feet to a point
25.00 feet Sally of the Sally right of way boundary of
Ramp B -C of Franklin Road Interchange of U. S. Highway
I -84N (formerly I -80N);
Thence SEly a distance of 79.20 feet along the arc of a
curve to the left that is concentric with and 25.00
feet Sally of said SVdly right of way boundary, said arc
having a radius of 395.O0 feet, a central angle of 11
29'18" and a long chord which bears S 45 22 E, a
distance of 79.07 feet; th S 0 09 W along a line
parallel with said East right of way boundary, a
distance of 344.91 feet; th S 89 27 W along a line
parallel with said North boundary, a distance of 474.46
feet to a point on said East right of way boundary of
Specht Avenue; th N D° 09 E along said East right
of way boundary, 400.00 feet to the TPOB.

Section 2. That a public hearing was held on March 21
1e88, by the City Council of said City of Caldwell, zuuun, and no
objections to said vacation were recorded.
Section 3, That it is hereby determined that, when
construction of a proposed motel facility on the site identified
as Lot 4 of Caldwell Interstate mo' u subdivision, (also
described as the parcel excepted from Parcel z of this ordinance)
recommences and said subdivision plat is filed, vacation of the
afore-mentioned premises in the City of Caldwell will be in the
best interest of the Rublir,
section o. Be it ordained and established that the afore-
mentioned premises in the city of Caldwell, cooxou County, Idaho,
shall be vacated and shall no longer be open or subject to the
one of the public upon filing of the plat of Caldwell Interstate
mo, u in the office of the cao»ou county Recorder, and thereupon
title to said premises in the city of Caldwell, Canyon County,
Idaho, sxuzz pass and revert to the persons dedicating the same,
or their successors, heirs and assigns in the manner in which
they were so dedicated.
Section 5. All ordinances or parts of ordinances in
conflict herewith are hereby regeoleu.
Section 8, This ordinance shall be in full force and effect
l& days after recording of the plat of Caldwell Interstate mo, z
subdivision at the office of the Recorder of Canyon County,
Idaho.
