A f AN ORDINANCE TO ESTABLISH A LOCAL LAT- ERAL SEWER IMPROVEMENT DISTRICT IN "HE CITY OF CALM - WELL IDAHO TO PROVIDE POR THE APPOINTMENT OF A SEWERAGE COMMITTEE AND CONFER UPON THEM CERTAIN POKERS TO PROVIDE FOR THE CONSTRUCTION OF A SYSTEM OF LATERAL SEWERAGE AND SEWER DISPOSAL WORKS IN SAID IMPROVEMENT DISTRICT. BE IT ORDAINED BY THE MAYOR AND COUN -- OIL OF THE CITY OF CALDWELL: Section 1. That there is hereby estab- lished a local irq)roveraent distract in the City of Caldwell, Idaho, to be known as Local Later4l Sewer Improvement District No. 4, which district is bound- ed and described as follows, to wit: Beginning at the intersection of Den- ver Street and 12th Avenue North, rrxnning thence scnitheasterly along Denver Street to its intersec- tion with 14th Avenue North; thence southwesterly, along said 14th Avenue North, to its intersection with Chicago Street; thence southeasterly, along Chicago Street to its intersection with 15th Avemxe North; thence southwesterly, along said 15th Ave, Worth, to its intersection with Belmont Street; thence north- y .` 0 r westerly along said Belmont Street to Pis intersec- tion with 14th Avenue North; thence southwesterly along said 14th Avenue Forth, to its intersection with the alley between Albany Street and the Oregon Short Line Right of lay; thence northwesterly along said alley to its intersection with 12th Avenue North; thence northwesterly along said 12th Avenue North, to the place of beginning above described. Also, begiinning at the intersec- tion of 11th Avenue and Denver Street, and manning thence northwesterly along Denver Street to its in- tersection with 7th Avenue North; thence northeast- erly along .7th Aventie North, to its intersection with Freeport Street thence southeasterly.along Freeport Street to its intersection with 11th Avenue North; and thence southwesterly, along llth Avetrxe North, to the place of beginning, above described. Being all of blocks numbered 56, 58 and 60 of Foot Vie., Addition; 84, 85, 60, 61 57, 58, 104, 56, and 45 of the Original Townsite. Also, Blocks rpanbered 47, 48, 49, 50, 52, 53, and 54 of the Original Townsite; 53 and 54, Boone Addition; 78 of Devers Addition, and the Dement Block. All in the City of Caldwell, Idaho. All the property fronting and abutting on any of the streets and alleys above mentioned and inolxded between and within the points designated are hereby declared to be within the said sewer district. -2- i ♦ 1 a Section 2. The Mayor of the City of Caldwell shall, within ten days after the passage of this ordinance, appoint a sewer committee composed of three members who shall be bona fide residents and substantial tax payers of the City of Caldwell, one of whom shall be appointed for one year, one for two years, and one for three years, and they shall serve until their successors are appointed and qualified. Said Comid ttee shall organize and elect a President as a presiding officer of their number who shall be styled chairman of the committee, appoint a clerk and treasurer who shall be, respectively, the clerk and treasurer of the City of Caldwell, all as provided by law. Section B. The treasurer of said Committee shall give a good and sufficient bond, in addition to his official bond, in the stun of $500.00, con — ditioned for the faithful performance of his ditties as such treasurer of said committee, according to law. Section 4. Said Committee shall have all the powers contained in Chapter 14, Title 13, Polit- ical Code, Idaho Revised Codes, including the power to have specifications prepared for the construction of the works hereinafter provided for, and to approve the same and do all things necessary to the comple— tion of said work. Section 5. There shall be constructed in the City of Caldwell, through said committee, a system of sewerage and sewerage disposal works to be so planned —3— i — 0 A a and constructed as to be directly beneficial to the property situated in said lateral se rage improve - ment district NO. 4, and of as much benefit to the remainder of the City as,in the jud of said com- Td ttee,is possible. In adopting said plans, the committee shall endeavor to cause the property with- in the said district to receive as nearly equal bene- fit as possible. Section 6. Upon the adoption of the plans and specifications, as herein provided, the said committee shall determine, as equally as can be done, the amount, of money to be raised for the con- struction of said works. Thereupon, .the said com- uu ttee, with the standing con nittee,on streets of the City Council,shall proceed to make an assessment roll of the real property contained within the boundaries of said district, PROVIDED, that property occupied by streets, cross streets and alleys within said dis- trict shall not be included within said assessment roll. The said assessment roll shall contain the names of the owners of the property assessed, a descrip- tion of the said property in separate parcels, or tracts, the front feet of the property, the amount of the special benefit of the property, if arty, and the amount assessed against the said property shall be equal to the amount of money determined upon to be raised as herein provided. Section 7. The said assessment roll shall be certified to the council by the committees making the same, and the clerk shall thereupon give notice -4- h as regiiired by law, of the filing of said assess- ment roll, and of the titre at which the council will hear and consider objections to said assessment roll by the.party aggrieved by said assessment, as provided by the laws of the State of Idaho, herein - before mentioned. The proceedings for hearing said objections, and all the actions of the council and the parties thereto, Shall conform-to the }provisions of the aforesaid laws. i Section S. When the said system is com- pleted and ready for use, the said committee shall turn the said system over to the said mayor and city council to be operated by said city. Section 9. The said sewerage committee shall be governed in the performance of their duties, in addi- tion to what is herein contained, by all the provisions of the laws of the State of Idaho relating to cities and villages.
