HomeMy WebLinkAboutORD 1753BILL NO. 14 ORDINANCE NO. 1753 AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE THEREFORE WAS GIVEN, DETERMINING THAT VACATION OF THE FOLLOWING DESCRIBED REAL PROPERTY SHALL BE MADE: A 25-foot strip of land being 12 1/2 feet on either side of the centerline of Main Street extended, commencing at the intersection of the centerline of Main Street extended Northwesterly and the North line of Calloway Addition, the official plat of which is on file and of record in the office of the Recorder of Canyon County, Idaho, and running thence in a Northwesterly direction 340 feet more or less to Indian Creek. AND THAT SAID VACATION IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above-described property located in Caldwell, Canyon County, Idaho; that statutory notice has been given to citizens and owners of property in the City of Caldwell, Idaho, in accordance with Section 50-1306A, Idaho Code; and that a public hearing was held before the City Council of said City of Caldwell, Idaho, on Monday, August 17, 1987, at which hearing no objections to said vacation were heard. Section 2. That the City Council does hereby make the following findings: a. The subject property deeded by quitclaim deed in 1904 to the City of Caldwell was for a sewer outfall into Indian Creek from one of the earlier sewer systems along Main Street. b. The outfall is no longer used for se'titary sewer purposes, although there may be drainlines that still flow into the line and empty into Indian Creek. C. A new easement for rerouting of drainage facilities can be negotiated with the property owner. d. The value of the easement granted will be equal to the value of the deeded property to be vacated. Section 3. That it is hereby determined the vacation of the above-described premises in the City of Caldwell, Canyon County, Idaho, is in the best interest of the public and shall be ORDINANCE - 1 subject to granting of easement for relocation of drainage lines as determined by the City Engineer. Section 4. Be it ordained and established that the above- described premises in the City of Caldwell, Canyon County, Idaho, shall be vacated and shall no longer be open or subject to the use of the public; and thereupon title to said premises shall pass and revert to the persons dedicating the same or their successors, heirs and assigns in the manner in which they were so dedicated.
