HomeMy WebLinkAboutORD 1750BILL NO. 11 ORDINANCE NO. 1750 AN ORDINANCE AMENDING TITLE V, CHAPTER 3 OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO, PERTAINING TO ELECTRICAL CODE BY DELETING AND ADDING CERTAIN LANGUAGE IN SECTION 2, CHAPTER 3 OF TITLE V REGARDING ADOPTION OF UNIFORM ADMINISTRATIVE CODE AND BY ADDING A SECTION 10, CHAPTER 3, TITLE V REGARDING CITY LICENSE REQUIRED, AND BY ADDING A SECTION 11, CHAPTER 3, TITLE V REGARDING LICENSE FEES; AND ADDING A SECTION 12, CHAPTER 3, TITLE V REGARDING REVOCATION OR SUSPENSION OF LICENSE: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Section 2, Chapter 3, Title V of the Municipal Code of the City of Caldwell, Canyon County, Idaho be amended as follows: 5 -3 -2: ADOPTION OF UNIFORM ADMINISTRATIVE CODE: There is hereby adopted for the purpose of administering the Electrical Code that certain Administrative Code known as the "Uniform Administrative Code Provisions" published by the International Conference of Building Officials, i-"4 current Editi Section 2. That a Section 10, regarding City License Required be added to Chapter 3, Title V of the Municipal Code of the City of Caldwell, Canyon County, Idaho as follows: 5 -3 -10: CITY LICENSE REQUIRED: Before any perso shall carry on or engage in the work or busines of electrical installations within the City of Caldwell, he shall p rocure a license from the City Clerk. The license is not transferable. Every applicant for a licen sh all present his State of Idaho license in person to either the - PAGE 1 - Building In or the City Cler for verifi cation. That a Section 11, regarding License Fee be added to Chapter 3, Title V of the Municipal Code of the City of Caldwell, Canyon County, Idaho as follows: 5 -3 -11: LICENSE FEES: Befo a ny license is issu the applica sha pay to the City Clerk a license fee in the amount of Twenty & 00 /00 Dollars ($20.00). Section 4. That a Section 12, regarding procedure for revocation or suspension of license be added to Chapter 2, Title V of the Municipal Code of the City of Caldwell, Canyon County, Idaho as follows: 5 -3 -12: R OR SUSPENSION OF LICENSE: Th right shall be and remai at all times vested in the Mayor a nd City Coun to rev oke or suspend for a set period of time any license for good cause. Whenever information shall come to the Building Official or any other official of the City that any licensee has committed any act or omit any act that would render his license subject to revocation or sus pension, it shall be the duty of the Officer having the information to forthwith submit the facts in writing to the Mayor and City Council. Should it appear to the Council from such report that there is good cause for revocation or suspension of such license, the licensee shall personally be served with a notice of hearing setting a time and 21ace where the licensee may appear for the purpose of responding t the report given to the City Council. That hearing shall be set no s than seven (7) days nor later than thirty ( 30) days from the time of personal service of the report on th li censee. ^ Th hearing shall be for the purpose of the City Council determining w hether or not the license shall be revoked or suspended for a set period of time. This ordinance shall be in full force and effect on and after January 1, 1988, after its passage, approval and publication according to law.
