ORDINANCE NO. 1749
AN ORDINANCE AMENDING TITLE V, CHAPTER 2 OF THE
MUNICIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO,
PERTAINING TO PLUMBING CODE BY ADDING A NEW SECTION 6
REGARDING LICENSE REQUIRED, BY ADDING A NEW SECTION 7
REGARDING LICENSE FEES, AND ADDING A SECTION 8
REGARDING REVOCATION OR SUSPENSION OF LICENSE:
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That a Section 6 regarding license required
be added to Chapter 2, Title V of the Municipal Code of the
City of Caldwell, Canyon County, Idaho as follows:
5 -2 -6: CITY LICEN REQUIRED: Before any person shall
carry on or en in the work or business of plumbi
installations in the City of Caldwell, he shall procure a
license from the City Clerk. The license is n ot
transferable. Every applicant for a license shall present
his State of Idaho license in person to e ithe r the Building
Inspector or the City Clerk for verification. The licens
shall be displayed in public view in the applicant's place
of business. The licensee shall renew the license annually.
Section 2. That a Section 7 regarding license fee be
added to Chapter 2, Title V of the Municipal Code of the
City of Caldwell, Canyon County, Idaho as follows:
5 -2 -7: LICENSE FEES: Before any license is issued
the applicant shall pay to the City Clerk a license fee in
the _amount of Twenty & 00 /00 Dollars (
Section 3. That a Section 8 regarding procedure for
revocation or suspension of license be added to Chapter 2,
Title V of the Municipal Code of the City of Caldwell,
Canyon County, Idaho as follows:
5 -2 -8: REVOCATION OR SUSPENSION OF LICENSE: The right
shall be and remain at all ti mes vested in the Mayor and

Council to revoke or suspend for a set period of time any
license for go od cause. Whene information shall come t
the Building Official or any other officer of the City that
any licensee has committed any act or omitted any act tha
would r e nd er his license subject to revocation o
suspens it shall be t he duty of th officer having the
inf ormation to forthwith submit the facts in writing to th
Mayor and City Council. Should it appear to the Council
from such report that there is good cause for revocat or
suspension of su ch license, the licensee shall personall_y bg
served with a notice of hearing setting a time and place
where the licensee m ay appear for the purpose of responding
to the report given to the City Council. That hearing shall
be set no sooner than seven (7) days nor later than thirt
(30) days from the time of personal service of the report on
the licens The hearing shall be for the purpose of the
City Co u n cil determining whether or not the license shall be
revoked or suspended f or a set period of time. The licensee
m ay be represented at said hear by any person of hi
choosing and may present evide t o refute all allegations
(For purposes of this Ordinance "good cause" shall mean any
act that endangers life or propert o r actions that are
contrary to City Ordinance. Below listed are example _that
are p r ov ided for illustrative purposes and i n o way limit
the Cit authority under this O rdinance: (a) Commencing
work prior to securing a permit; (b) Performing work withou
a permit; (c) Completing work without proper ins (d)
Con viction for a violation of proper business practices or
a crime e invo lving moral turpitude; (e) Failure to correct
identif C ode violations in a timely manner.
Section 4. All ordinances or parts of ordinances
inconsistent herewith are hereby repealed.
Section 5. This ordinance shall be in full force and
effect on and after January 1, 1988, after its passage,
approval and publication according to law.
