ORDINANCE NO. 1742
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT THE OWNERS OF SAID LAND HAVE
CONSENTED AND AGREED THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE C -4(AP) INTERCHANGE OR FREEWAY
COMMERCIAL (AIRPORT OVERLAY) ZONE; AND DECLARING SAID LAND BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS, OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CITY ENGINEER TO ADD SAID PROPERTY TO THE OFFICIAL
MAP OF THE CITY OF CALDWELL, IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALD-
WELL, IDAHO:
Section 1. That the following- described land is contiguous
and adjacent to the City of Caldwell, Idaho; and that the owners
of said land have consented and agreed that said following des-
cribed land should be annexed to the City of Caldwell, Idaho:
A parcel of land being all that portion of the West 134.8
feet of Tracts 4 and 14 and all that portion of Tracts 5
and 10 of City View Tracts in Section 26, Township 4 North,
Range 3 West of the Boise Meridian as shown and designated
on the official plat on file and of record in the office
of the Recorder of Canyon County, Idaho, lying and being situ-
ate Northeasterly of the center of an irrigation canal of the
Canyon Hill Irrigation District (formerly Caldwell Irrigation
District) and Southwesterly of the Southwesterly right of way
boundary of I -84 (formerly Interstate Highway 80 North as
described in that certain Warranty Deed to the State of Idaho
dated April 24, 1965, recorded June 9, 1965, in Book 299 of
Deeds at Page 528 as Instrument Number 567161, records of
Canyon County, Idaho).
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the land described above by
proper legal description is hereby declared to be a part of the
City of Caldwell, Canyon County, Idaho.
Section 3. It is further declared that said land described
above shall hereby be made a part of the C -4(AP) interchange or
freeway commercial zone (Airport Overlay).
Section 4. Saving Clause. Should any section, subsection,
sentence, or clause in this ordinance, for any reason be declared
unconstitutional, void, ineffective, or invalid, no other part
of this ordinance which can be given effect notwithstanding shall
be invalid, void, ineffective, or fail on account thereof.
ORDINANCE - 1
Section 5. All ordinances, resolutions, orders or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 6. This ordinance shall be in full force and effect
from and after its passage, approval and publication, according
to law.
Section 7. The land described in said ordinance shall be
subject to taxation as other property and persons within the cor-
porate limits of the City of Caldwell, Canyon County, Idaho, upon
filing of a certified copy of this ordinance with the County Re-
corder and County Assessor of the County of Canyon, State of
Idaho, and the State Tax Commission, State of Idaho.
