HomeMy WebLinkAboutORD 1740BILL NO. 1 ORDINANCE NO. 1740 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM M -l(AP) LIGHT INDUSTRIAL (AIRPORT OVERLAY) TO C -4(AP) INTERCHANGE OR FREEWAY COMMERCIAL (AIRPORT OVERLAY); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY AS C -4(AP) INTERCHANGE OR FREEWAY COMMERCIAL (AIRPORT OVERLAY) ON THE OFFICIAL ZONING MAP; AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALD- WELL, IDAHO: WHEREAS, It has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in 6 -4 -3, Caldwell Code that the following- described property be rezoned from M -l(AP) Light Industrial (Airport Over- lay) to C -4(AP) Interchange or Freeway Commercial (Airport Over- lay) and that said rezoning is in the best interest of the City of Caldwell, Idaho: BEGINNING at the Northwest corner of the Northeast Quarter of Section 26, Township 4 North, Range 3 West of the Boise Meridian, which corner is also the intersection of the cen- terline of Franklin Road with the centerline of Specht Avenue; thence South along said centerline of Specht Avenue and Specht Avenue extended, approximately 1,300 feet to its in- tersection with the centerline of Commercial Way extended; thence Easterly along said centerline of Commercial Way and Commercial Way extended to its intersection with the South- westerly right of way line of Interstate Highway 84; thence Northwesterly along said Southwesterly right of way line of Interstate Highway 84 to its intersection with the centerline of Franklin Road, which line is also the North line of said Northeast Quarter of Section 26; thence Westerly along said North line to the POINT OF BEGINNING. IT IS HEREBY ORDAINED AS FOLLOWS: Section 1. That certain land described above is now zoned C -4(AP) Interchange or Freeway Commercial (Airport Overlay) and shall be so changed from M -l(AP) Light Industrial (Airport Over- lay) after the date of this ordinance. Section 2. The City Engineer of the City of Caldwell is hereby instructed to so designate the same above - described property on the Official Zoning Map of the City of Caldwell, Idaho, as being C -4(AP) Interchange or Freeway Commercial (Airport Overlay). ORDINANCE - 1 Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 4. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
