ORDINANCE NO. 1728
AN<ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPRO-
PRIATE NOTICE THEREFOR WAS GIVEN; AND DETERMINING THAT VACATION
OF SEWER EASEMENTS DESCRIBED IN EXHIBIT A ATTACHED IS IN THE BEST
INTEREST OF THE CITY OF CALDWELL, IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALD-
WELL, IDAHO:
Section 1. That an application has been presented to the Mayor
and Council of the City of Caldwell, Idaho, requesting passage and

approval of an ordinance vacating the sewer easements described in
Exhibit A attached and located in Tracts 14 and 15 of Mountain View
Subdivision No. 2, the Plat of which is on file in Book 2 of Plats,
Page 66, intthe office of the Recorder of Canyon County, Idaho, and
through a portion of vacated Oregon Avenue; and that statutory notice
was given to citizens and owners of property in the City of Caldwell,
Idaho, in accordance with 50- 1306A, Idaho Code and,
Section 2. That it is hereby determined it is in the best
public interest that the sewer easements described in Exhibit A be
vacated.
Section 3• Be it ordained and established that the sewer ease-
ments described in Exhibit A and located in the City of Caldwell,
Canyon County, Idaho, shall be vacated and shall no longer be sub -
ject to the use of the public; and thereupon title to said sewer
easements shall pass and revert to the persons dedicating the same
or their successors, heirs and assigns. Said sewer easements shall
be vacated and shall pass and revert to the persons dedicating the
same, or their successors, heirs and assigns in the manner in which
they were so dedicated.
Section 4. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
PASSED BY THE COUNCIL of the City of Caldwell this 21st day of

EXHIBIT A
An easement twenty (20.00) feet in width located in portions of
Tracts 14 and 15 (also known as Blocks 14 and 15) of Mountain View
Subdivision No. 2 0 the Plat of which is on file in Book 2 of Plats,
Page 66, in the Office of the Recorder of Canyon County, Idaho; and
through a portion of vacated Oregon Avenue:
Commencing at the Northwest corner of said Tract 14; thence East,
a distance of 270.50 feet along the South boundary of Ash Street
to a point on the intersection of the West side of Idaho Avenue;
thence South, a distance of 245.00 feet; thence West, a distance
of 201.00 feet to the TRUE POINT OF BEGINNING;
thence West,.a distance of 69.59 feet to a point on the West
boundary of said Tract 14 and continuing West 30.00 feet to a point
on the former center line of vacated Oregon Avenue;
thence South 0 02' 00" West, a distance of 20.00 feet along the
former centerline of said vacated Oregon Avenue to a point;
thence East, a distance of 30.00 feet to a point on the West
boundary of said Tract 14, and continuing East, a distance of 49.59
feet to a point; thence South 2 0 25 1 20" East,.a distance of 171.11
feet to a point on a contingent boundary;
thence North 89 0 33 1 50" East, a distance of 20.85 feet along a con-
tingent boundary;
thence North 2 0 25 1 20" West, a distance of 190.97 feet to the TRUE
POINT OF BEGINNING;
and also,
an easement twenty (20.00) feet in width located in Tract 15 (also
known as Block 15) of said Mountain View Subdivision No. 2:
Commencing at the Southwest corner of said Tract 15; thence North
• distance of 75.00 feet to a point; thence North 89 0 33 1 50" East,
• distance of 61.05 feet to the TRUE POINT OF BEGINNING;
thence North 89 0 33'50" East along a contingent property line, a
distance of 104.72 feet to a point; thence South a distance of
95.00 feet to a point on the street right of way; thence South
89 0 33 1 50" West along the street right of way, a distance of 20.00
feet to a point; thence North a distance of 75.00 feet to a point;
thence South 89 0 33 0 50" West, a distance of 84.72 feet to a point;
thence North, a distance of 20.00 feet to the TRUE POINT OF BE-
GINNING.
