ORDINANCE 1726
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL,IDAHO,FROM R-2TF MEDIUM DENSITY RESIDENTIAL (Mobile
Home and Flood Plain Overlays)TO C-3TF SERVICE COMMERCIAL (Mobile
Home and Flood Plain overlays);DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,IDAHO;
INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY AS C-3TF
SERVICE COMMERCIAL ON THE OFFICIAL ZONING MAP;AND REPEALING ALL
LAWS,ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL,IDAHO:
WHEREAS,it has been determined by the City Council of the
City of Caldwell,Idaho,upon recommendation of the Planning and
Zoning Commission and following the public hearing procedures as
required in 6-4-3,Caldwell Code,that the following-described
property be rezoned from R-2TF Medium Density Residential (Mobile
Home and Flood Plain Overlays)to C-3TF Service Commercial (Mobile
Home and Flood Plain Overlays),and that said rezoning is in the
best interest of the City of Caldwell:
A part of Block 6 in the Golden Gate Subdivision to Caldwell,
Idaho,according to the official plat on file in Book 3 of Plats
at page 26,in the office of the Recorder of Canyon County,
Idaho;more particularly described as follows:
Commencing at the intersection of the centerlines of Boise
Avenue and Elgin Street;thence N 46°14'23"W,407.87 feet
along the centerline of Elgin Street to the POINT OF BEGINNING;
thence N 56o38'07"E,344.68 feet to a point on the centerline
of Freeport Street;thence N 46°14'23"W along said centerline,
348.00 feet;thence S 46°57'37"W,336.52 feet to a point on
the centerline of Elgin Street;thence S 46°14'23"E along
said centerline,290 feet to the POINT OF BEGINNING.
Property addresses included in the rezoning are 212 and 224
W.Elgin Street.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1.That certain land described above is now zoned
C-3TF Service Commercial and shall be so changed from R-2 TF Medium
Density Residential (Mobile Home and Flood Plain Overlays)after
the date of this ordinance.
Section 2.The City Engineer of the City of Caldwell is
hereby instructed to so designate the same above-described property
on the Official Zoning Map of the City of Caldwell,Idaho,as being
C-3TF Service Commercial.
Section 3.All ordinances,resolutions,orders or parts there
of in conflict herewith are hereby repealed,rescinded and annulled.
Section 4.This ordinance shall be in full force and effect
from and after its passage.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL this 5th day
of May,1986.
