HomeMy WebLinkAboutORD 1725BILL NO.10 ORDINANCE NO.1725 AN ORDINANCE CHANGING THE ZONING OP CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL,IDAHO,FROM R-2 MEDIUM DENSITY RESIDENTIAL TO R-3 MULTI-FAMILY HIGH DENSITY RESIDENTIAL;DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO;INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY AS R-3 MULTI-FAMILY HIGH DENSITY RESIDENTIAL ON THE OFFICIAL ZONING MAP;AND REPEALING ALL LAWS,ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,,IDAHO: WHEREAS,it has been determined by the City Council of the City of Caldwell,Idaho,upon recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in 6-4-3,Caldwell Code,that the following-described property be rezoned from R-2 Medium Density Residential to R-3 Multi-Family High Density Residential,and that said rezoning is in the best interest of the City of Caldwell: A part of Tracts J and L and all of Tracts S and T of Mountain View Subdivision,the official plat of which is on file and of record in Book 2 of the Plats at page 66 in the office of the Canyon County Recorder,Idaho,more particularly described as follows: BEGINNING at the southwest corner of Lot 7 of One Linden Plaza Subdivision,on file and of record in the office of the Recorder, Canyon County,Idaho;thence East along the south boundary and the south boundary extended of One Linden Plaza to the centerline of S.Georgia Avenue;thence South along the centerline of S. Georgia Avenue to its intersection with the centerline of Locust Street;thence East along the centerline of Locust Street to its intersection with the east boundary extended of Tract T of Mountain View Subdivision;thence South along said east line and east line extended to the centerline of Cherry Street; thence West along the centerline of Cherry Street to the centerline of the Pioneer Irrigation College Lateral;thence Northerly along the centerline of said College Lateral to the south line extended of One Linden Plaza Subdivision;thence east along said south line extended to the southwest corner of Lot 7 of said One Linden Plaza,the POINT OF BEGINNING. IT IS HEREBY ORDAINED AS FOLLOWS: Section 1.That certain land described above is now zoned R-3 Multi-Family High Density Residential and shall be so changed from R-2 Medium Density Residential after the date of this ordinance. Section 2.The City Engineer of the City of Caldwell is hereby instructed to so designate the same above-described property on the Official Zoning Map of the City of Caldwell,Idaho,as being R-3 Multi-Family High Density Residential. Section 3.All ordinances,resolutions,orders or parts there of in conflict herewith are hereby repealed,rescinded and annulled. GJL Mayor ATTEST: City Clerk 'v> -2- March 12, We residents of South ^brgia Street,Caldwell,hereby ^^t it ion the city to close- Georgia south of the junction with Beech Street for the reason that it is inadequate as "backdoor"access to the subdivision off Florida Avenue. Here are some points to consider: 1)South of Beech,Georgia is a one-lane track with a canal bordering it,not suitable as a two-way street 2)The nature of Georgia Street promotes speeding,which under the conditions is reckless driving.For several blocks south of Linden,Georgia is wide and paved, and the apartments and trailer park fronting it are set well back.At Cherry Street, Georgia suddenly narrows and becomes gravel.Houses crowd the street,and front yards spill into the street without separating curbs or sidewalks.Children are at risk from speeding cars and flying gravel. 3)In the past few months,these incidents have happened on Georgia Street:two cars have run into the canal south of Beech;a car has gone through a lawn;several cars have stormed by at 50 to 60 m.p.h.;a dog has been killed;two cars were drag- racing,etc. 4)Dust and noise are a nuisance 5)Closing Georgia at Beech will slow and reduce the traffic coursing through this residential neighborhood,preserving the safety of both drivers and resident children.The subdivision traffic will be routed back to the more suitable Florida Ave. Name Address Date
