ORDINANCE NO. 1713
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO
ELECTRICAL CODE BY REPEALING CHAPTER 3, SECTIONS 1 THROUGH
16 OF TITLE V AND ADDING A NEW CHAPTER 3, SECTIONS 1 THROUGH
9, TITLE V PERTAINING TO ELECTRICAL CODE: REPEALING ALL
ORDINANCES, RESOLUTIONS, OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Chapter 3, Sections 1 through 16, Title V
be repealed.
Section 2. That a new Chapter 3, Sections 1 through 9, Title
V be added as follows:
5 -3 -1: ADOPTION OF ELECTRICAL CODE: There is hereby adopted
for the purpose of establishing minimum standards of design, materials,
and workmanship for all electrical installations hereafter installed,
altered or repaired and to establish methods of procedure, within the
limits of this Municipality that certain Electrical Code known as the
"National Electrical Code" published by the National Fire Protection
Association, being the current Edition of said Code as adopted by
the State of Idaho, and the whole thereof, except as amended by
making insertions here below, and of which not less than three (3)
copies, including copies of said insertions, deletions, substitutions,
additions, or amendments have been and now are filed in the Office of
the Clerk, and the same is hereby adopted and incorporated as fully
as if set out at length herein.
5 -3 -2: ADOPTION OF UNIFORM ADMINISTRATIVE CODE: There is
hereby adopted for the purpose of administering the electrical code
that certain Administrative Code known as the "Uniform Administrative
Code Provisions" published by the International Conference of
Building Officials , 1984 Edition.
5 -3 -3: STATE CONTRACTOR'S LICENSE REQUIRED TO ENGAGE IN
BUSINESS: Any individual or firm desiring to engage in the business
of an Electrical Contractor must first obtain a current Electrical
Contractor's License from the State of Idaho. Excepted from this
licensing requirement shall be the seller of electrical appliances
at retail, who in the regular course of business connects appliances
to electrical wiring systems, provided there is no alteration in
the system or any required new wiring.

5 -3 -4: FEES: From and after January 1, 1986, applicants for
Electrical Permits shall pay to the Building Official fees established
by the Building Official by Rule and Regulations subject to the
approval of the City Council.
5 -3 -5: ENERGIZING OF THE ELECTRICAL SYSTEM: The Power Company
shall not connect to or furnish electrical energy to any electrical
installation until notified by the Building Official that the final
inspection has been made and the work found satisfactory; provided,
that temporary connection may be made upon the approval of same by
the Electrical Inspector. The Electrical Inspector shall have the
power to enter any building in the City for the purpose of inspecting
any new or existing electrical installation and shall have the power
to condemn and cause the removal of or repair of any installation
found unsafe and faulty. Notice of such condemnation shall be given
the owner of occupant of such building in writing and if the defects
are not corrected within a reasonable time the Electrical Inspector
shall order the power company to disconnect the service to the building
and to refrain from furnishing electrical energy to the building
which contains the defective installation.

5 -3 -6: ELECTRIC SIGNS: All electric signs shall be erected
under the supervision of the Building Inspector and such erection shall
require a permit.
5 -3 -7: RULES AND REGULATIONS GOVERNING WIRING:
(A) Types of wiring in buildings used for other than residential
purposes: Building which are used for commercial, industrial,
or other like occupancies shall have electrical wiring
installed in conduit or in electrical metallic tubing or surface
metal raceway when the total square footage of the building
exceeds one thousand five hundred (1,500) square feet.
(B) Range Wiring: All range wiring shall be at least three (3)
No. 8 B & S gauge wire of an approved type cable.
5 -3 -8: VIOLATIONS AND PENALTIES: Any person violating any of
the provisions of this Code shall be deemed guilty of a misdemeanor

and upon conviction thereof shall be punished by a fine not to exceed
three hundred dollars ($300) or by imprisonment not to exceed thirty
(30) days or by both such fine and imprisonment. Each separate day or
any portion thereof during which any violation of this Code occurs or

continues shall be deemed to constitute a separate offense, and upon
conviction thereof shall be punishable as herein provided. In
addition to or in place of other penalties provided by this Code,
failure to obtain a permit when required shall cause that permit fee
to be quadrupled.
5 -3 -9: DAMAGE NOT ASSUMED BY MUNICIPALITY: This Chapter shall
not be construed to relieve from or lessen the responsibility of any
person owning, using or installing any electrical system or electrical
fixtures, for damages to anyone injured or damages either in person
or property by any defect therein; nor shall the City or any agent
thereof be held as assuming such liability by reason of inspection
authorized herein or certificates of inspection issued by the
Administrative authority.
Section 3. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to law.
