ORDINANCE NO. 1712
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO
PLUMBING CODE BY REPEALING CHAPTER 2, SECTIONS 1 THROUGH 6
OF TITLE V AND ADDING A NEW CHAPTER 2, SECTIONS 1 THROUGH 5,
TITLE V PERTAINING TO PLUMBING CODE: REPEALING ALL ORDINANCES,
RESOLUTIONS, OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Chapter 2, Section 1 through 6, Title V be
repealed.
Section 2. That a new Chapter 2, Sections 1 through 5, Title
V be added as follows:
5 -2 -1: ADOPTION OF PLUMBING CODE: There is hereby adopted
for the purpose of establishing minimum standards of design,
materials and workmanship for all plumbing hereafter installed,
altered or repaired and to establish methods of procedure within
the limits of this City that certain Plumbing Code known as "Uniform
Plumbing Code" published by the International Association of Plumbing
and Mechanical Officials, which not less than three (3) copies have
been and now are filed in the Office of the Clerk, and the same is
hereby adopted and incorporated as fully as if set out at length
herein.
5 -2 -2: STATE CONTRACTOR'S LICENSE REQUIRED TO ENGAGE IN
BUSINESS: Any individual or firm desiring to engage in the business
of a Plumbing Contractor must first obtain a current Plumbing
Contractor's License from the State of Idaho.
5 -2 -3: FEES: From and after January 1, 1986, applicants for
permits shall pay to the Building Official fees established by the
Building Official by rule and regulations subject to the approval of
the City Council.
5 -2 -4: VIOLATIONS AND PENALTIES: Any person violating any of
the provisions of this Code shall be deemed guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine not to exceed
three hundred dollars ($300) or by imprisonment not to exceed thirty
(30) days or by both such fine and imprisonment. Each separate day or
any portion thereof during which any violation of this Code occurs

or continues shall be deemed to constitute a separate offense, and
upon conviction thereof shall be punishable as herein provided. In
addition to or in place of other penalties provided by this Code,
failure to obtain a permit when required shall cause that permit fee
to be quadrupled.
5 -2 -5: DAMAGE NOT ASSUMED BY MUNICIPALITY: This Chapter
shall not be construed to relieve from or lessen the responsibility
of any person owning, using or installing any plumbing or plumbing
fixtures, for damages to anyone injured or damages either in person
or property by any defect therein; nor shall the City or any agent
thereof be held as assuming such liability by reason of inspection
authorized herein or certificates of inspection issued by the
Administrative authority.
Section 3. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to law.
