AN ORDINANCE TO AMEND SECTION 1, OF CHAPTER 3, TITLE VII,
OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO, PERTAINING TO GARBAGE BY ADDING AND
DELETING CERTAIN LANGUAGE WITH REGARD TO SUBSECTION UNDER
DEFINITIONS ENTITLED RESIDENTIAL UNITS AND MULTI FAMILY
RESIDENTIAL UNITS: REPEALING ALL ORDINANCES, RESOLUTIONS,
OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the subsection regarding Residential Unit
under Section 1: DEFINITION be amended and an additional subsection
entitled Multi Family Residential Units be added as follows:

RESIDENTIAL UNITS: A division of la or property containing one
or two dwelli units within the corporate limits of the C ity
occupied by a person or group of persons. A residenti unit
is de emed occupied when either water or electrical services
are being sup plied thereto. Each individual residential
units r efuse coll fee m ay either be billed separately
or to the owner
MUL FAMILY RE UNITS: A group of three (3) or more
dwelling units i one location, regardless of any lot or
property divisions, which are owned, managed, or controlled
one indiv idual or organization. Each residential unit may

be bille separately, unles t he owner fails to keep or
cause to be kept, all bags, bundles and containers in such
manner t hat there is no scatt ering of refuse as prohibited
by_aection 7 -4 - 2. If afte issuance of a second five day
notice within an 12 mont p eriod the owner ha failed to
comply w S ection 7 -4 -2, the C it may require that the
owner shall supply a commer bin or box and be billed
for the balance of any mont cha that is not already
b by the tenant or occupants. The City shall
require t hat the bi remain for a period of 12 months.
After a period of three month the owner may request a
re- evaluation and if the City can verify that there is
continuing complia with Section 7 -4 -2, the C ity may
allow the retu of the bin to the refuse collection
company. A req bin will not diminish the owner's,
man ager's, or oc responsibility to jointly and
severe cIgMjZ with the provisions of Title 7, Chapter 4
of the Caldwell Municipal Code.
Section 2. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
