HomeMy WebLinkAboutORD 170261 BILL NO. 17 ORDINANCE NO. 1702 AN ORDINANCE TO REPEAL CHAPTER 4, TITLE VIII OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO AND ADD A NEW CHAPTER 4, TITLE VIII, SECTIONS 1 TO 6 WITH REGARD TO WEEDS; REPEALING ALL ORDINANCES, RESOLUTIONS, OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1: That Chapter 4, Title VIII, Sections 1 through 3 be repealed. Section 2. That a new Chapter 4, Title VIII, Sections 1 through 6 be added as follows: 8 -4 -1: DEFINITION: Undesirable plant growth that is unkept, unsightly, deleterious and /or injurious to the public. Weeds include noxious weeds, grasses, unkept bushes, and any plant meeting this description. 8 -4 -2: WEEDS TO BE DESTROYED: Every person residing, doing business, owning, managing, renting or leasing property within the City limits of Caldwell shall be required to keep weeds over eight inches (8 ") in height (see definition herein), continuously cut down, weeded out, removed or destroyed. This shall not only include all weeds on private property, but weeds situated on public property adjacent to or contiguous with private property including areas behind curbs, sidewalks, parking areas, and property to the center of alleys and ditches. 8 -4 -3: CITY MAY CAUSE CLEAN UP OF WEEDS AND CHARGE AGAINST PROPERTY: Every person owning, managing, occupying, renting, leasing, or using property within the City limits of Caldwell shall keep weeds over eight inches (8 ") in height continuously destroyed, weeded out and cut down. The Mayor or City Council may five days after notice, cause weed removal, obliteration or cutting as often as necessary, on lots, lands or premises not in compliance. The expenses of such work shall be assessed against the property involved as general taxes and �J collectible as other general State, County and Municipal taxes. 8 -4 -4: PENALTY FOR VIOLATIONS: Any person owning, managing, or occupying any lots, lands or premises within such incorporated limits of the City who shall, after notice, fail, refuse or neglect to continuously keep weeded out, cut down, obliterated or destroyed, the herein described weeds, grasses and growths in the manner prescribed in accordance with the provisions of Section 8 -4 -2, shall be deemed guilty of a misdemeanor. 8 -4 -5: EACH FIVE DAYS SEPARATE OFFENSE: Each and every five (5) days any such person mentioned and described herein shall fail, refuse or neglect to comply with the provisions of this Chapter shall constitute a separate and distinct offense against the provisions of this Chapter, and each of such separate offenses shall be punishable as provided by the provisions entitled "Penalty for Violations ". 8 -4 -6: GRANT OF AUTHORITY TO EMPLOY LABOR: The Mayor and City Council of the City are hereby given the power and authority to employ such labor as is necessary to carry out the provisions of this Chapter and allow the bills therefor. Section 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 4. This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
