ORDINANCE NO. 1699
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO, FROM R -1 SINGLE FAMILY RESIDENTIAL TO
C -4 INTERCHANGE OR FREEWAY COMMERCIAL; DETERMINING THAT SAID CHANGE
IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO;
INSTRUCTING THE CITY ENGINEER TO DESIGNATE SAID PROPERTY AS C -4
COMMERCIAL ON THE OFFICIAL ZONING MAP; AND REPEALING ALL LAWS, OR-
DINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and
Zoning Commission and following the public hearing procedures as
required in 6 -4 -3, Caldwell Code that the following - described
property be rezoned from R -1 Single Family Residential to C -4
Interchange or Freeway Commercial and that said rezoning is in
accordance with the Comprehensive Plan and is in the best interest
of the City of Caldwell:
Commencing at the Northeast corner of the Southeast Quarter
of the Southwest Quarter of Section 23, Township 4 North,
Range 3 West of the Boise Meridian and run thence West along
the North boundary line of said Southeast Quarter of the South-
west Quarter, a distance of 170 feet to the POINT OF BEGINNING;
Thence West along said North line, 500 feet to the Northwest
corner of the East one -half of the Southeast Quarter of the
Southwest Quarter of said Section 23, thence South 0 °52' East
along the West boundary line of the East one -half of the South-
east Quarter of the Southwest Quarter, a distance of 278.4 feet
to a point in the North boundary line of Interstate 84; thence
South 61 0 36' East along said North line, a distance of 531 feet;
thence in a Northerly direction, a distance of 537.5 feet to
the POINT OF BEGINNING.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1. That certain land described above is now zoned
C -4 Interchange or Freeway Commercial and shall be so changed from
R -1 Single Family Residential after the date of this ordinance.
Section 2. The City Engineer of the City of Caldwell is
hereby instructed to so designate the same above- described property
on the Official Zoning Map of the City of Caldwell, Idaho, as being
C -4 Interchange or Freeway Commercial.
Section 3. All ordinances, resolutions, orders or parts thereof
in conflict herewith are hereby repealed, rescinded and annulled.
Section 4. This ordinance shall be in full force and effect
from and after its passage.
