AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPRO-
PRIATE NOTICE THEREFOR WAS GIVEN; AND DETERMINING THAT VACATION
OF THE EAST 5 FEET OF A 10 -FOOT UTILITY EASEMENT ON THE FOLLOWING -
DESCRIBED REAL PROPERTY IS IN THE BEST PUBLIC INTEREST FOR THE
CITY OF CALDWELL, IDAHO:
Lot 5, Block 1, New Country Meadows Subdivision, the
official plat of which is on file and of record in the
office of the Recorder of Canyon County, Idaho.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor
and City Council of the City of Caldwell, Idaho, on the 22nd day
of April, 1985, and statutory notice having been given to citizens
and owners of property in the City of Caldwell, Idaho, in accord-
ance with Section 50- 1306A, Idaho Code that an application has
been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting passage and approval of an ordinance vacating
the east 5 feet of the 10 -foot utility easement on the above -
described real property located in Caldwell, Canyon County, Idaho.
Section 2. That it is hereby determined it is in the best
public interest that the east 5 feet of the 10 -foot utility ease-
ment on the above - described property in the City of Caldwell,
Canyon County, Idaho, be vacated.
Section 3. Be it ordained and established that the east 5
feet of the 10 -foot utility easement on said Lot 5, Block 1, New
Country Meadows Subdivision, Caldwell, Canyon County, Idaho, shall
be vacated and shall no longer be subject to the use of the public;
and thereupon title to said east 5 feet of the 10 -foot utility
easement on the above - described real property in the City of Caldwell,
Canyon County, Idaho, shall pass and revert to the persons dedicating
the same or their successors, heirs and assigns. The above - described
east 5 feet of said 10 -foot utility easement shall be vacated and
shall pass and revert to the persons dedicating the same, or their
successors, heirs and assigns in the manner in which they were so
dedicated.
Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
