ORDINANCE NO. 1687
AN ORDINANCE TO AMEND CHAPTER 13, TITLE IV, OF THE MUNICIPAL CODE
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO BY ADDING AND
DELETING CERTAIN LANGUAGE PERTAINING TO POOL AND BILLIARD HALL LICENSES
REQUIRED, FEES, MINORS, AND LICENSE RESTRICTIONS: REPEALING ALL
ORDINANCES, RESOLUTIONS, OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
Section 1: That Chapter 13, Title IV be amended as follows:
CHAPTER 13

4 -13 -1: LICENSE REQUIRED: It shall be unlawful for any person to
operate, maintain, or conduct a billiard, pool or bagatelle
hall er -eard -Teem open to the public without first obtaining a
license therefor.
(A) All applications for a license must be in writing and filed
with the Clerk. Every applicant for a license under this Chapter
shall state his full name, or if more than one person, or if an
association or corporation, the full names of all parties
interested, or the name of the corporation. The application

shall also state the following:
1. The exact location including street and number where said
billiard, pool or bagatelle hall er - eard - ream is to be operated
and maintained.
2. The name under which the billiard, pool or bagetelle hall
or-eard -ream will be maintained and operated.
All licenses shall be granted by the Mayor and Council for a
period of one year beginning January 1 and ending December 31st.
A full year's license fee shall be collected for each license
issued. All license fees shall be paid in advance.
4 -13 -2: FEES: Before a license shall be issued to operate or open
a billiard, pool or bagatelle hall or-eard -ream the person,
partnership, association or corporation, as the case may be,
shall pay to the Clerk a license fee as follows:

{R} (A) A nnual fee of fifty dollar•($50.00) for a billiard,
(r pool, or bagatelle hall, together with a fee of five dollars ($5.00)
for each billiard or pool table on the premises.
Said license shall expire on the last day of each calendar year.
The license issued by virtue of this Chapter shall be non-
transferable.

4 -13 -3: LICENSE RESTRICTIONS: As a condition to the granting of
billiard, pool, bagatelle or- eard -reem licenses, the Council of
the City of Caldwell, shall have the privilege of denying any
application for license if in the opinion of the Council that the
granting of said license would be contrary to the general welfare
of the City.
Should a license be denied under the provision of this Section,
the applicant may appeal to the Council for a hearing on the same.

The decision of the Council after said hearing shall be final
with respect to the granting or refusing of said license.
Section 2: All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 3: This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
