HomeMy WebLinkAboutORD 1683,o BILL NO. 21 ORDINANCE NO. 1683 AN ORDINANCE TO AMEND THE MUNICIPAL CITY CODE OF THE CITY OF CALDWELL, IDAHO, BY CREATING A NEW SECTION: TITLE II, CHAPTER 12, SECTION 1 THROUGH 6 IN REGARDS TO MULTI- PURPOSE STADIUM COMMISSION: SETTING FORTH CREATION, MEMBERSHIP AND TERMS OF OFFICE, ORGANIZATION; RULES, RECORDS, AND MEETINGS; AND POWERS AND DUTIES. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; Section 1. That Title II of the Municipal Code be amended to add Chapter 12, Sections 1 through 6 as follows: 2 -12 -1: CREATION: There is hereby created a Commission to be known as the Multi- Purpose Stadium Commission. 2 -12 -2: MEMBERSHIP; TERMS OF OFFICE: The Multi- Purpose Stadium Commission hereby created shall consist of not less than five (5) nor more than seven (7) voting members, and five (5) non - voting members. Two of the voting members must be the President of the College of Idaho or a designee and the Mayor of the City of Caldwell or a designee. Among the five (5) non - voting members shall be one Councilperson appointed by the Mayor, a County Commissioner, the Superintendent of School District 132 or a designated representative, and the Athletic Director of the College of Idaho. The voting members, other than the President of the College of Idaho and the Mayor or designees, shall be appointed by the Mayor with the majority approval of the City Council. All voting members, other than the President of the College of Idaho and the Mayor or their designees shall serve for three (3) years, excepting that there shall not be more than five (5) members whose terms shall expire in any given year and excepting and providing further that the terms of the initial members to be appointed shall be subject to the Terms and Provisions of Section 2 -12 -4, as set forth infra, and captioned "Organization ". 2 -12 -3: COMPENSATION; VACANCIES: The members of the Commission hereby created shall be selected without regard to political affiliations and shall serve without compensation. Vacancies shall be filled by the Mayor with the advice and majority consent of the City Council. i d 1 2 -12 -4: ORGANIZATION: The Commission shall elect a Chairman and create and fill any other office that is deemed necessary. The Commission may establish subcommittees, advisory committees or neighborhood groups to advise and assist in carrying out responsibility under this Ordinance and provisions of the Idaho State Code. 2 -12 -5: RULES, RECORDS, AND MEETINGS: Written organization papers or bylaws consistent with this Ordinance and other laws of the State of Idaho for the transaction of business of the Commission shall be adopted. A record of meetings shall be maintained. At least one regular meeting per month shall be held. A majority of voting members of the Commission shall constitute a quorum. 2 -12 -6: POWERS, DUTIES: It shall be the duty of the Commission to provide for its own manager and to submit to the City Council the following: A. The general use of all lands and buildings encompassing the Multi- Purpose Stadium Complex. B. The user fees to be charged. C. Capital improvements needed. D. Methods of increasing the assets of the facility. E. To recommend a budget and the authorization of expenditures. Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 3. This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
