ORDINANCE NO. 1675
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE
THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE UTILITY, DRAINAGE
AND IRRIGATION EASEMENTS ON THE FOLLOWING DESCRIBED REAL PROPERTY, TO -WIT:
A utility, drainage, and irrigation easement 10 feet in width
traversing a portion of Block 1 of "HAPPY DAY BUSINESS CENTER"
(a recorded subdivison on file as Instrument No. 889019, Records
of Canyon County, Idaho) said easement being 5 feet in width on
either side of the following described line:
Commencing at a steel pin monumenting the most westerly corner of
Lot 3 of said "HAPPY DAY BUSINESS CENTER ", said pin being the REAL
POINT OF BEGINNING.
Thence S46 19' -00 11 E a distance of 240.00 feet to a steel pin,
Thence S18 55' -00 "E a distance of 96.28 feet to a steel pin,
said pin being the terminus of this description (from which the
most westerly corner of said Lot 3 bears N38 33' -52 "W a distance
of 328.48 feet);
and also,
A utility, drainage, and irrigation easement 10 feet in width
traversing a portion of Block 1 of "HAPPY DAY BUSINESS CENTER"
(a recorded subdivision on file as Instrument No. 889019, Records
of Canyon County, Idaho) said easement being 5 feet in width on
either side of the following described line:

of Lot 6 of said "HAPPY DAY BUSINESS CENTER ", said steel pin be-
ing the REAL POINT OF BEGINNING.
Thence N44 14' -19 "E a distance of 122.60 feet to a steel pin,
said pin being the terminus of this description.
IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO:
Section 1. That by a Motion passed and approved by the Mayor and City
Council of the City of Caldwell, Idaho, on the 26th day of June, 1984, and
statutory notice having been given to citizens and owners of property in
the City of Caldwell, Idaho, that an application has been presented to the
Mayor and Council of the City of Caldwell, Idaho, requesting passage and
approval of an ordinance vacating the above utility, drainage and irrigation
easements located in Caldwell, Canyon County, Idaho.
Section 2. That it is hereby determined that it is in the best public
interest that the above - described utility, drainage and irrigation easements
in the City of Caldwell, Canyon County, Idaho, be vacated and that the
utilities be rerouted.
Section 3. Be it ordained and established that the above - described
utility, drainage and irrigation easements in the City of Caldwell, Canyon
County, Idaho, as more particularly described above, shall be vacated and
shall no longer be subject to the use of the public; and thereupon title
ORDINANCE - 1
to said utility, drainage and irrigation easements in the City of Caldwell,
Canyon County, Idaho, above described, shall pass and revert to the persons
dedicating the same or their successors, heirs and assigns. The above -
described utility, drainage and irrigation easements shall be vacated and
shall pass and revert to the persons dedicating the same, or their success-
ors, heirs and assigns in the manner in which they were so dedicated.
Section 4. That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
PASSED BY THE COUNCIL of the City of Caldwell this 17th � day of
