ORDINANCE NO. 1667
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF CALD-
WELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND CITY COUNCIL INTEND
TO SELL THE FOLLOWING DESCRIBED REAL PROPERTY OWNED BY THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; AND WHICH SAID PROPERTY IS SITUATED
IN CANYON COUNTY, IDAHO; THAT SAID SALE IS MADE UNDER THE PROVISIONS
OF TITLE 50, CHAPTER 14, IDAHO CODE; THAT SAID SALE OF SAID PROPERTY
SHALL BE AT PUBLIC AUCTION AND SHALL BE SOLD TO THE HIGHEST BIDDER
AND THAT NO BID SHALL BE ACCEPTED FOR LESS THAN THE APPRAISED VALUE;
SAID PROPERTY BEING DESCRIBED AS FOLLOWS, TO -WIT:
That property being in the Northwest 1/4 of the Southeast 1/4
of Section 15, Township 4 North, Range 3 West of the Boise Meri-
dian, more particularly described as follows:
Commencing at the East Corner of Block 83 of Golden Gate Addi-
tion in the City of Caldwell, Idaho, said point also being the
intersection of the centerline of West Plymouth Street and the
northwesterly right of way line of First Avenue; thence North-
westerly along the Northeasterly boundary of Blocks 82 and 83,
which line is also the centerline of Plymouth Street, a distance
of 759 feet to the TRUE POINT OF BEGINNING; thence at right an-
gles to the centerline of Plymouth Street, a distance of 180 feet
more or less to the intersection with the North line of the North-
west Quarter of the Southeast Quarter; thence West along the North
line of the Northwest Quarter of the Southeast Quarter, a distance
of 260 feet more or less to the intersection of the centerline of
Plymouth Street; thence Southeasterly along the centerline of Ply-
mouth Street, a distance of 185 feet more or less to the TRUE POINT
OF BEGINNING;
Excepting therefrom a forty foot half right of way width for Ply-
mouth Street from the centerline described and also excepting
therefrom a 50 -foot right of way for a southerly extension of
Rice Avenue.
The right of way reserved for Rice Avenue splits the above -des-
cribed property into two parcels, approximately 0.16 acres and
0.02 acres respectively.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and Council of the City of Caldwell,
Idaho, hereby intend to sell at public auction the following des-
cribed real property situated within Canyon County, Idaho, said
property being described as follows, to -wit:
That property being in the Northwest 1/4 of the Southeast 1/4
of Section 15, Township 4 North, Range 3 West of the Boise
Meridian, more particularly described as follows:

the TRUE POINT OF BEGINNING;

Section 2. That the ordinance for the sale of said above -des-
cribed real property will be considered under a suspension of the
requirements that an ordinance be read on three different days at
a meeting of the Council of the City of Caldwell, Idaho, to be held
on the 17th day of January, 1984, at the hour of seven - thirty p.m.
at the Council Chambers in the City Hall in the City of Caldwell,
Idaho, when and where, or prior to said date, any citizen of the
City of Caldwell, Idaho, or any number of citizens may express dis-
satisfaction with said sale as set forth in Section 50 -1203, Idaho
Code, wherein it is provided that if a petition expressing dissatis-
faction with said sale containing the names of qualified electors
of the City in a number equal to ten percent (10 %) of the total votes
cast for Mayor at the preceding City election is filed with the City
Clerk during sixty (60) days from the passage of this ordinance, the
City Council shall cause a special election to be held on the ques-
tion of whether or not the real property shall be sold.
Section 3. The said above - described property shall be sold at
public auction to the highest bidder and no bid shall be accepted
for less than the appraised price and the City Council may reject
any and all bids.
Section 4. Notice of the foregoing will be given to all citizens
of the City of Caldwell, Canyon County, Idaho, by publication of this
ordinance in the City of Caldwell, Idaho, in three issues thereof
published on the 23rd and 30th of January, 1984, and the 6th of
February, 1984.
Section 5. That this ordinance shall be in force and effect
from and after its passage, approval and publication.
