HomeMy WebLinkAboutORD 1655a BILL NO. 20 ORDINANCE NO. 1655 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -2T MEDIUM DENSITY RESIDENTIAL WITH A MOBILE HOME OVERLAY TO M -1T LIGHT INDUSTRIAL WITH A MOBILE HOME OVERLAY AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL LAWS, ORDI- NANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, It has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, and following the public hearing procedures as required, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter as Exhibit A be rezoned, it is hereby ordained as follows: Section 1. That certain land described in Exhibit A attached hereto, and by this reference incorporated herein, is now zoned R -2T Medium Density Residential, and is located within the City of Caldwell, County of Canyon, State of Idaho, the Council having pre- viously annexed said land to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tract of land described in Exhibit A. a proper legal description, to be declared to be M -1T Light Industrial, and shall be so changed from R -2T Medium Density Residential after the date of this Ordinance. Section 3. That said rezoning is in accordance with the Com- prehensive Plan for the City of Caldwell, Idaho. Section 4. The City Clerk of the City of Caldwell and the City Engineer of the City of Caldwell are hereby instructed to so desig- nate the same above- described property on the official zoning map of the City of Caldwell, Idaho, as being M -1T Light Industrial property. Section 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 6. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. APPROVED BY THE MAYOR of the City of Caldwell this 16th day of August, 1983• ATTEST: City Clerk ORDINANCE - 2 • EXHIBIT A All of Block 63 of Golden Gate Addition to Caldwell, Idaho, and a parcel of land in Block 55 of said Golden Gate Addition des- cribed as follows: BEGINNING at the East corner of said Block 55; thence Southwesterly along the Southeasterly line of said Block 55, 208 feet; thence Northwesterly and parallel with the Southwesterly line of said Block 55, 135 feet; thence Northeasterly and parallel with the Northwesterly line of said Block 55, 208 feet to the Northeasterly line of said Block 55; thence Southeasterly along said Northeas- terly line, 135 feet to the POINT OF BEGINNING.
