AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO, FROM R -2 MEDIUM DENSITY RESIDENTIAL TO
R -3 MULTI - FAMILY HIGH DENSITY RESIDENTIAL AND DETERMINING THAT
SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALD-
WELL, IDAHO; REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
WHEREAS, It has been determined by the City Council of the City
of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, and following the public
hearing procedures as required, that it is in the best interest of
the City of Caldwell, Idaho, that certain property described here-
after as Exhibit A be rezoned, it is hereby ordained as follows:
Section 1. That certain land described in Exhibit A attached
hereto, and by this reference incorporated herein, is now zoned
R -3 Multi- family High Density Residential, and shall be so changed
from R -2 Medium Density Residential after the date of this Ordinance.
Section 2. The City Clerk of the City of Caldwell and the City
Engineer of the City of Caldwell are hereby instructed to so desig-
nate the same above - described property on the official zoning map of
the City of Caldwell, Idaho, as being R -3 Multi- family High Density
Residential property.
Section 3. All ordinances, resolutions, orders or parts thereof
in conflict herewith are hereby repealed, rescinded and annulled.
Section 4. This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.

• EXHIBIT A
BEGINNING at the intersection of the centerline of Morrison Street
with the centerline of S. Kimball Avenue, as shown on the plat of
Arlington Addition to Caldwell, Idaho; thence South along; the cen-
terline of S. Kimball Avenue, 80 feet to the South lot line extended
of Lot 12, Block 12 of said Arlington Addition; thence East along;
said South lot line and lot line extended, 165.7 feet to the center-
line of the alley in said Block 12; thence North along said center-
line, 80 feet to its intersection with the centerline of Morrison
Street; thence West along; said centerline, 165.7 feet to the POINT
OF BEGINNING.
This property is known as 1501 S. Kimball Avenue, including adjacent
rights -of -way.
SIGN -UP SHEET FOR PUBLIC HEARINGS
No person shall be permitted to speak before City Council at a Public
Hearing until recognized by the Mayor. All persons speaking shall speak
before a microphone in such a manner as will assure that the recorded
testimony or remarks will be accurate and trustworthy. At the commencemen
of the Hearing, the City Council shall establish a time limit to be obsery
by all speakers. When the Public Hearing is quasi- judicial in nature or
one after which the City Council is required by law to make Findings of
f Act, each speaker must swear or affirm that his testimony will be true
and correct. Any person refusing to comply with rules will be prohibited
from speaking during the Public Hearing.
