AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPRO-
PRIATE NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF
THE SOUTH 4 FEET OF THE 16 -FOOT UTILITY AND DRAINAGE EASEMENTS
ON THE FOLLOWING DESCRIBED REAL PROPERTY IS IN THE BEST PUBLIC
INTEREST FOR THE CITY OF CALDWELL, IDAHO:
Lots 1 and 8, Block 5, and Lots 1 and 8, Block 7 of Syl-
van Manor Subdivision, as shown on the official plat thereof
on file and of record in the office of the Recorder of Canyon
County, Idaho, more particularly described as follows:
Commencing at the Northwest corner of Lot 1, Block 5 of Sylvan
Manor Subdivision; thence South along the West lot line of said
Lot 1, 12.00 feet to the POINT OF BEGINNING; thence East on a
line parallel with the North line of said Lot 1, 127.26 feet;
thence South on a line parallel with the East line of said Lot
1, 4.00 feet; thence West on a line parallel with the North
line of said Lot 1, 127.26 feet to the West line of said Lot 1;
thence North on said West line, 4.00 feet to the POINT OF BE-
GINNING; and also,
Commencing at the Northeast corner of Lot 8, Block 5 of said
Sylvan Manor Subdivision; thence South along the East lot line
of said Lot 8, 12.00 feet to the POINT OF BEGINNING; thence
West on a line parallel with the North line of said Lot 8,
127.26 feet; thence South on a line parallel with the West
line of said Lot 8, 4.00 feet; thence East on a line parallel
with the North line of said Lot 8, 127.26 feet to the East
line of said Lot 8; thence North on said East line, 4.00 feet
to the POINT OF BEGINNING; and also,
Commencing at the Northwest corner of Lot 1, Block 7 of said
Sylvan Manor Subdivision; thence South along the West lot line
of said Lot 1, 12.00 feet to the POINT OF BEGINNING; thence
East on a line parallel with the North line of said Lot 1, 121.32
feet; thence South on a line parallel with the East line of said
Lot 1, 4.00 feet; thence West on a line parallel with the North
line of said Lot 1, 121.32 feet to the West line of said Lot 1;
thence North on said West line, 4.00 feet to the POINT OF BE-
GINNING; and also,
Commencing at the Northeast corner of Lot 8, Block 7 of said
Sylvan Manor Subdivision; thence South along the East lot line
of said Lot 8, 12.00 feet to the POINT OF BEGINNING; thence West
on a line parallel with the North line of said Lot 8, 121.33
feet; thence South on a line parallel with the West line of said
Lot 8, 4.00 feet; thence East on a line parallel with the North
line of said Lot 8, 121.33 feet to the East line of said Lot 8;
thence North on said East line, 4.00 feet to the POINT OF BE-
GINNING.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a motion passed and approved by the Mayor and
City Council of the City of Caldwell, Idaho, on the 7th day of June,
1983 and statutory notice having been given to citizens and owners
of property in the City of Caldwell, Idaho, requesting passage and
approval of an ordinance vacating the south 4 feet of the 16 -foot
utility and drainage easements described above located in Caldwell,
Canyon County, Idaho.

Section 2. That it is hereby determined it is in the best public
interest that a portion of the above- described utility and drainage
easements be vacated.
Section 3. Be it ordained and established that the south 4 feet
of the 16 -foot utility and drainage easements as described above in
the City of Caldwell, Canyon County, Idaho, shall be vacated and shall
no longer be subject to the use of the public; and thereupon title
to said portion of easements in the City of Caldwell, County of Canyon,
Idaho, above - described, shall pass and revert to the persons dedicating

the same, or their successors, heirs and assigns in the manner in which
they were so dedicated.
Section 4. That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
