ORDINANCE NO. 1642
AN ORDINANCE AMENDING TITLE IV, CHAPTER 20, SECTION 3 AND SECTION 5 OF
THE MUNICIPAL CODE OF THE CITY OF CALDWELL, IDAHO, RELATING TO ESCORT
SERVICE BY DELETING SECTION 3 (D) PERTAINING TO QUALIFICATIONS FOR PERMIT
AND ADDING A NEW SECTION 3 (D) PERTAINING TO QUALIFICATIONS FOR PERMIT
WITH REGARD TO INSURANCE; AND ADDING TO SECTION 5 PERTAINING TO LIMITATIONS;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS HEREOF IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL of the City of
Caldwell, County of Canyon, State of Idaho:
Section 1. That Section 3 (D), Chapter 20, Title IV of the
Municipal Code of the City of Caldwell be amended as follows:
4 -20 -3: QUALIFICATIONS FOR PERMIT: A permit shall not be issued
to any person to act as an escort officer unless:
(A) They are at least twenty -one (21) years of age.
(B) They have resided within the State for a continuous
period of at least six (6) months preceding the date
of application.
(C) They have not been convicted in any court within a
period of two (2) years of an offense of driving a motor
vehicle while under tie influence of intoxicating liquor
or drugs, reckless driving, the use of drugs or marijuana
or any felony.

(D) Liability Insuran in t amount of not less than
$ 100,000 per person, $300,000 per occurrence and bodily
i njury and $100,000 per occurrence property damage shall
b e filed with the Office of the City Clerk prior to th
issuance of license.
Section 2. That Section 5, Chapter 20, Title IV be amended as
follows:
4 -20 -5: LIMITATIONS: Any license or permit issued hereunder shall

be limited to the licensee to provide escort service for,
and to escort, funeral processions and moving buildings only,
unless special permission is obtained to escort other
types of traffic movements with the authorization of the
Chief of Police. By issuing a license or permit, the
C ity of Caldwell assumes no responsibility or liability
Section 3. That all ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. That this ordinance shall be in force and effect from
and after its passage, approval and publication according to law.
